HomeMy WebLinkAboutR-16-0019Vop City of Miami '"* Legislation < U R �O Resolution: R-16-0019 File Number: 15-01670 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 1/14/2016 A RESOLUTION OF THE MIAMI CITY COMMISSION DIRECTING THE CITY ADMINISTRATION TO DEVELOP THE SCOPE, DETERMINE THE COST, AND OUTLINE THE TIMEFRAME ASOCIATED WITH CONDUCTING A STUDY PURSUANT TO CHAPTER 13 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED ("CITY CODE"), ENTITLED "DEVELOPMENT IMPACT AND OTHER RELATED FEES," REGARDING THE FEASIBILITY OF CREATING A TRANSPORTATION IMPACT FEE; FURTHER DIRECTING THE CITY ADMINISTRATION TO RETURN TO THE JANUARY 28, 2016 COMMISSION MEETING WITH A STATUS UPDATE AS TO THIS TRANSPORTATION STUDY, AND TO CONDUCTA TRIENNIAL IMPACT FEE REVIEW PURSUANT TO SECTION 13-13(G) OF THE CITY CODE, TO DETERMINE IF CHANGES IN COSTS, CITY FACILITY NEEDS, OR DEVELOPMENT PATTERNS DICTATE A NEED TO UPDATE ANY OTHER IMPACT FEES. WHEREAS, Chapter 13 of the Code of the City of Miami, Florida, as amended ("City Code"), provides for certain impact fees to be imposed on new development within the City, specifically intended to fund increases in public facilities and services associated with such development; and WHEREAS, Section 13-13(g) of the City Code states that "the City shall conduct a complete review of the impact fees every three (3) years to determine if changes in costs, facility needs, development patterns, demographics and any other relevant factors indicate a need to update the impact fee calculations, data, methodology, or other components of the impact fee system"; and WHEREAS, a substantial increase in new development in the City of Miami ("City") has led to a rise in traffic density and demand for City facilities, specifically transit -related services; and WHEREAS, a study may reveal the need to create a transportation impact fee to address such increases associated with this new development; and WHEREAS, the cost of engaging a consultant, timeframe necessary to conduct a study, and the study's overall scope must be determined; and WHEREAS, the City administration is to return to the second City Commission meeting in January 2016, to provide a status update as to timeframe, cost, and scope related to such study; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. The City Commission directs the City Administration to develop the scope, determine City of Miand Page 1 of 2 File Id. 15-01670 (Version: 2) Printed On: 4/16/2018 File Number: 15-01670 Enactment Number: R-16-0019 the cost, and outline the timeframe associated with conducting a study of the feasibility of creating a transportation impact fee within Chapter 13 of the City Code in order to address the increase in transit density issues as a result of new City-wide development. Section 3. The City Commission further directs the City Administration to return to the January 28, 2016 Commission meeting to provide a status on conducting such study. Section 4. The City Administration is directed to conduct review of the current impact fees, to be conducted triennially pursuant to Section 13-13(g) of the City Code, to examine whether changes in costs, City facility needs, or development patterns dictate a need to update any other impact fees. Section 5. This Resolution shall become effective upon its adoption and signature of the Mayor.{1 } Footnotes: {1} This Resolution shall become effective as specified herein unless vetoed by the Mayor within ten (10) days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later.
