A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
MAKING FINDINGS AND APPROVING A REDUCTION OF THE WATERFRONT
SETBACK AND SIDE SETBACK REQUIREMENTS PURSUANT TO SECTION
3(MM)(III) OF THE CHARTER OF THE CITY OF MIAMI, FLORIDA, AS AMENDED,
FOR THE GROVE BAY RESIDENCES PROJECT LOCATED AT APPROXIMATELY
3581 EAST GLENCOE STREET, MIAMI, FLORIDA; REQUIRING THATAPPLICANT
CLEAN, CLEAR, AND IMPROVE THE AREA LOCATED BETWEEN LOTS 8 AND 9,
BETWEEN SOUTH BAYSHORE AND BISCAYNE BAY, AND BLOCK 5 OF THE
GLENCOE SUBDIVISION, TO INCLUDE A DECORATIVE FENCE, LANDSCAPING
AND OTHER IMPROVEMENTS TYPICAL OF A POCKET PARK; AND REQUIRING
THAT APPLICANT AND SUCCESSORS IN INTEREST MAINTAIN THE SUBJECT
AREA.
WHEREAS, on October 20, 2015, Javier E. Fernandez, Esquire, on behalf of Grove Bay
Properties, LLC ("Applicant"), submitted a request for a Special Appearance to request: 1) a reduction
of the required Waterfront Setback from 50 feet to 25 feet; and 2) a reduction of the 25% Side
Setback requirement from 20.92 feet to 15 feet for the Grove Bay Residences project located at 3581
East Glencoe Street, Miami, Florida; and
WHEREAS, this request to reduce the waterfront setback and the bay walk within the project is
subject to City Commission approval pursuant to Section 3(mm)(iii) of the Charter of the City of Miami,
Florida, as amended ("Charter"), and Article 3, Section 3.11 of the Miami 21 Code, the Zoning
Ordinance of the City of Miami, as amended ("Miami 21 Code"); and
WHEREAS, applicant shall clear, clean, and improve the area located between lots 8 and 9,
between South Bayshore and Biscayne Bay, and block 5 of the Glencoe Subdivision as recorded in
Plat Book 5, Page 119 of the public records to include a decorative fence, landscaping, and other
such improvements typical of a pocket park; and
WHEREAS, applicant and successors in interest shall be required to maintain the subject area
where these future improvements will be located, for the benefit of all residents of Glencoe; and
WHEREAS, the City Commission has considered the Applicant's request and deems it advisable
and in the best interest of the general welfare of the City of Miami to approve reduction of the
Waterfront Setback and the required Side Setback within the Grove Bay Residences project; and
WHEREAS, the City Commission determines that the modifications requested provide public
benefits such as direct public access, public walkways, plaza dedications, covered parking up to the
floodplain level, or comparable benefits which promote a better urban environment and public
advantages, or which preserve natural features;

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The City Commission hereby finds that the Grove Bay Residences project complies
with the criteria found in Section 3(mm)(iii) of the Charter and Article 3, Section 3.11 of the Miami 21
Code, and hereby approves the following: 1) a reduction of the required Waterfront Setback from 50
feet to 25 feet; and 2) a reduction of the 25% Side Setback requirement from 20.92 feet to 15 feet for
the Grove Bay Residences project located at 3581 East Glencoe Street, Miami, Florida, legally
described in "Exhibit A", attached and incorporated; and 3) a requirement that applicant clean and
improve the area located between lots 8 and 9, between South Bayshore and Biscayne Bay, and
Block 5 of the Glencoe subdivision; and 4) a requirement that applicant and successors in interest
shall maintain the subject area where these improvements will be located.
Section 3. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor. {1 }
Footnotes:
{1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
