The deadline to file the complete application with supporting documents is the last five working
days of each month from 8;00 am until 3:00 pm, except on the fifth day, until 12:00 pm.
The application submittal date is the date stamped by Hearing Boards' staff on this page.
The responses to this application must be typed and signed in black ink. All pertinent and
accurate information%documentation; i.e,, the plans, reporfs, exhibits, shall be presented of the
time of filing, in addition to the paid receipt. The applicant is responsible for the accuracy of the
information contained in the application and all supporting materials. Should you wish, you
could bring the materials to our office for review prior to submittal to ensure completeness.
You will be responsible, if needed, to bring an interpreter for the English language to any
presentation before city boards, committees and the city commission. A valid power of attorney
will be required if neither applicant or legal counsel representing the applicant execute the
application or desire to make a presentation before city boards, committees and the city
commission. All documents, reports, studies, exhibits (8'/2x11 ") or other materials submitted
during this process will be kept as part of the record. Any documents offered to the Planning,
Zoning and Appeals Board and the City Commission, which have not been provided fifteen (15)
days before the meeting as part of the agenda materials will be entered into the record at the
discretion of the aforementioned Board and Commission.
ORDINANCE NO. 11469, CODIFIED IN CHAPTER 2, ARTICLE VI OF THE CITY CODE
STATES THAT ANY PERSON WHO RECEIVES COMPENSATION, REMUNERATION OR
EXPENSES FOR CONDUCTING LOBBYING ACTIVITIES TO REGISTER AS A LOBBYIST
WITH THE CITY CLERK, PRIOR TO ENGAGING IN LOBBYING ACTIVITIES BEFORE CITY
STAFF, BOARDS, COMMITTEES AND THE CITY COMMISSION. A COPY OF SAID

Charter Waterfront Setback Modification Application Submittal
Dear Ms. Zamora:
Our firm represents Grove Bay Properties, LLC (the "Applicant"), the contract purchaser and sponsor of
a proposed 26 -unit luxury condominium project (the "Project') to be constructed on the Property, The Applicant
requests your review of the enclosed documents/materials in connection with their request for the approval
certain modifications to the waterfront setback requirements set forth in Sec. 3(mm)(ii) of the City of Miami
("C y") Charter (the "Charter Required Setbacks") and certain Waivers required under the Miami 21 Zoning
Code ("Miami 21 ").
Enclosed with this letter of intent is a completed copy of the Special Appearance Application (the
"Application") and the required supporting documents identified on the Application checklist for your review.
Sec, 3(mm)(ii) of the City Charter establishes minimum waterfront setbacks and side yard setbacks for
the purpose of preserving the City's natural scenic beauty, guaranteeing open spaces, and protecting the
waterfront. To that end, the City Charter provides that no building permits for an enclosed structures located on
Biscayne Bay shall be issued which: (i) are not setback at least 50 feet from the seawall; and (ii) do not have
average side yards equal in aggregate to at least 25% of the water frontage of each lot based on average lot
width, Sec. 3(mm)(iii), however, authorizes the modification the Charter Required Setbacks by the City
Commission after design and site -plan review and public hearing upon a determination that: (i) the requested
modifications provide public benefits such as direct public access and public walkways; (ii) comparable benefits
which promote better urban environment and public advantages; or (ii) which preserve natural features
(collectively, the "Modification Standards"),
Consistent with the authority provided pursuant to Sec. 3(mm)(iii) of the City Charter, Applicant requests
the following modifications to the Charter Required Setbacks:
A reduction in the Charter Waterfront Setback from the required 50 feet to 25 feet (a 50%
reduction); and

2. A reduction to the 25% side yard requirement in aggregate — from the required 20,92 feet to
15 feet (a 28,3% reduction).
The Applicant's request is consistent with the Modification Standards in so far as they: (i) provide public access
and public walkways; and (ii) promote a better urban environment and public advantages in the following
manner:
■ Provide Public Access and Public Walkways, The Applicant's proposal will provide the sole point of
public access to the waterfront within the Glencoe subdivision and the adjacent Mercy Hospital
subdivision where members of the public can enjoy views and access to Biscayne Bay along a public
walkway, None of the other_ neighboring buildings situated on South Bayshore_Court _within_the Glencoe_
subdivision, including the Beacon Harbour Condominium constructed in 2004, provide any public
access to the waterfront. The Mercy Hospital subdivision, as evidenced by the photo enclosed as Exhibit
"A," at present, actively discourages public use and access of segments of the waterfront adjoining the
Property.
In the instant case, the Applicant's proposal provides public access to the waterfront via the setback
along the southern property line connected to South Bayshore Court. At the terminus of such
connection, both residents of the Project and of the Glencoe subdivision will be able to enjoy the public
walkway and amenities located on the segment of the bay walk proposed to be constructed by the
Applicant. In designing the waterfront amenity, you will note that the Applicant chose to prioritize the
public areas of the waterfront, through the creation of Circulation, Safety Buffer, and Passive Zones
consistent with the waterfront standards set forth in Appendix B of Miami 21 (the "Appendix"), and
deemphasize the private areas by limiting the waterfront setback reductions to the Transition and
Security Zone.
■ Promote a Better Urban Environment. The proposed Project improvements have been developed
consistent with the waterfront standards in the Appendix and will promote a better urban environment by
advancing the following general principles set forth therein as follows:
Public Access Waterfront Walkways— The improvements will:
a. Feel Public by incorporating signage to advise members of the public of their right to
use the walkway;
b. Be Usable through the design of improvements that minimize conflicts between active
and passive use zones;
c. Provide Visual Access by incorporating landscaping, furniture, Fighting, and planters
that have been subordinated to enhance visual access to the waterfront; and
d. Enhance Visual Quality of the waterfront through the screening of parking and service
areas from the walkway.
Design Standards for Waterfront Walkways — The Project waterfront improvements provide
landscaped areas improved with native plants and shade trees placed within the
Passive/Transition Zone,
3. Safety Buffer Zone — The proposed Project waterfront improvements include a 4 -foot wide
Safety Buffer Zone with textured, flat, white pebbles incorporated as the material serving to
distinguish the Safety Buffer Zone from the Circulation Zone, Planting beds and palms have
also been incorporated within this zone consistent with the standards in the Appendix.
Circulation Zone — Notwithstanding the requested modification reducing the Charter Required
Setbacks for the waterfront, the proposed Project waterfront improvements maintain a
Circulation Zone of not less than 15 -feet in width, The proposed Circulation Zone is

completely free of obstructions to movement and is proposed to be improved with non -slip
paving materials with a high aesthetic appeal identified on Sheet No, A-4.1 of the plans,
Finally, the promenade surface maintains a consistent elevation and is fully handicap
accessible throughout the Length of the walkway.
Passive Zone — A 3 -foot wide passive zone interspersed with shade trees, site furniture and
other accessories are proposed as part of the Project improvements. The proposed benches
preserve direct views of the water, while the paver pattern proposed for the Circulation Zone
will be continued within the Passive Zone consistent with the standards in the Appendix,
__6._ Transition and Security -Zone While the Applicant is seeking_a reduction of the Charter
Required Setback for the waterfront, the impact of the reduction has been limited to those
portions of the waterfront that would otherwise comprise the balance of the Transition and
Security Zone, so as to maximize the size of the Circulation Zone used by the public.
Notwithstanding the requested modification, the Applicant's proposed design provides for a
three (3) foot Transition and Security Zone consistent with the minimum requirements set forth
in the Appendix.
In addition to the Application's satisfaction of the Modification Conditions, it also advances a number
of Goals, Objectives and Policies set forth in the Future Land Use Element of the City's Comprehensive
Neighborhood Plan, Specifically, the Application is consistent or advances the following policies:
FUTURE LAND USE
■ Policy LU -1.5.2: Land Use regulations and development policies will be consistent with the
intent and purpose of Miami -Dade County's Waterfront Charter Amendment, Shoreline
Development Review Ordinance, rules of the Biscayne Bay Aquatic Preserve Management
Area, and other appropriate requirements regarding waterfront access and management.
The Application is consistent with the County's Shoreline Development Review Ordinance. Specifically,
the subject application serves to advance the objectives set forth in s, 33D -3I (d)(2), (3), (4), (5), and (10), as the
Project: (i) encourages the use of the shoreline for the benefit, use and enjoyment of County residents; (ii)
provides the maximum amount of public physical access to the water through the provision of a boardwalk
along the shoreline; (iii)orients the building uses towards the water; (iv) incorporates appropriate site
preparation and landscape design to avoid further walling -off of the shoreline; and (v) designs the proposed
building in a manner that will enhance the view and enjoyment water and shoreline from the water and from
within the development and overlooking the development.
PARKS, RECREATION AND OPEN SPACE
■ Policy PR -3.2.1: The City will continue to work to complete the Baywalk, encompassing as
much as the Biscayne Bay waterfront as possible, and to complete the Riverwalk and the Miami
River Greenway.
■ Policy PR -3,2,3: The City will incorporate provisions for public physical and/or visual access
to the shoreline in its waterfront zoning regulations.
■ Policy PR -3.2,11: As specified in the City of Miami Charter and Related Laws ... all new
development and redevelopment along the downtown waterfront is required to provide a
waterfront setback, and those developments that require publicly accessible shoreline walkways
will design them in conformance with the "Baywalk/Riverwalk Design Standards ...... The City
will monitor these areas to ensure continued public access, as required.

The Application advances the City's efforts to complete the Baywalk encompassing as much of the
bayfront as possible and adheres to both the letter and intent of the waterfront zoning regulations to ensure
physical access to the waterfront by the public as contemplated in Policies PR -3,2.1, PR -3.2.3, and PR -3.2.1 1.
COASTAL MANAGEMENT
■ Policy CM -2.1.6: The City will incorporate provisions for public physical and/or visual access
to the shoreline in its waterfront zoning regulations.
Policy_CM-2,1 7;_As _specified_in_ the _City of Miami Charter and related laws,_ and more
specifically the Waterfront Charter Amendment and Ordinance Zoning Ordinance for the City
of Miami all new development and redevelopment along the downtown waterfront is required to
provide a waterfront setback, and those developments within Special Districts (SDs) that require
publicly accessible shoreline walkways, will design them in conformance with the
"Baywalk/Riverwalk Design Standards."

As contemplated by Policies CM -2.1.6 and CM -2.1.7, the Application is consistent with zoning
regulations for public physical access to the shoreline and has been designed in conformance with the
"Baywalk/Riverwalk Design Standards."
For all of the foregoing reasons, we would respectfully request the City Commission's approval of the
Applicant's requested modification to the Charter Required Setbacks.

APPLICATION FOR CITY COMMISSION APPROVAL SUBJECT TO COMPLIANCE WITH
THE CITY CHARTER, CITY CODE, MIAMI 21 ZONING CODE, AND ALL OTHER

Pursuant tie Miami City Charter Section 3(mm) (iii) and the Miami 21 Code Article 3, Section 3.11 this propos
for "Grove Bay Residences," a 26 -unit condominium, located at 3581 E. Glencoe Street, Miami, Florida 33131,
which requires a Special Appearance Application. Proposal seeks a modification to allow a reduction of both the
Charter required waterfront and aggregate side -yard (View Corridor) requirements, which is subject to CITY
COMMISSION APPROVAL.
The proposed waterfront development consists of five (5) and four (4) story Residential condominium buildings of
26 total units with average unit sizes in excess of 2,000 square feet. The Residential units are serviced by a total of
not less than 42 parking spaces and related residential amenities.
