A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), BY
FOUR-FIFTHS (4/5THS) AFFIRMATIVE VOTE, PURSUANT TO SECTION 18-92 OF
THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, AFTER AN
ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING AND CONFIRMING
THE CITY MANAGER'S FINDING OF A SOLE SOURCE; WAIVING THE
REQUIREMENTS FOR COMPETITIVE SEALED BIDDING PROCEDURES
APPROVING THE PURCHASE OF FIVE (5) WEATHERBUG CAMERA SYSTEMS,
ACCESSORIES AND RELATED EQUIPMENT, FROM EARTH NETWORKS, INC.,
D/B/A WEATHERBUG, FOR THE DEPARTMENT OF FIRE -RESCUE, FOR A
PURCHASE AMOUNT OF $46,250.00; ALLOCATING FUNDS FROM THE
FIRE -RESCUE DEPARTMENT'S URBAN AREA SECURITY INITIATIVE GRANT,
ACCOUNT CODE NO. 11100.189000.664000.0000.00000, SUBJECT TO THE
AVAILABILITY OF FUNDS AND BUDGETARY APPROVAL AT THE TIME OF NEED;
FURTHER WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDDING
PROCEDURES FOR FUTURE PURCHASES OF THE WEATHERBUG CAMERA
SYSTEM, INCLUDING REPLACEMENTS, IMPROVEMENTS AND INTEGRAL
EQUIPMENT AS LONG AS IT REMAINS A SOLE SOURCE AS DETERMINED BY
THE CHIEF PROCUREMENT OFFICER.
WHEREAS, the Department of Fire -Rescue ("Department") is seeking to procure five (5)
WeatherBug Camera Systems, accessories and related equipment to replace non-functioning
cameras and to ensure the continuity of the Department's ability to track and monitor severe weather
conditions in and approaching the City of Miami ("City"); and
WHEREAS, Earth Networks, Inc., d/b/a WeatherBug ("WeatherBug"), is the sole source
manufacturer, seller and shipper of the WeatherBug Camera system, accessories and related
equipment and its products are registered trademarks that can only be acquired through
WeatherBug; and
WHEREAS, said equipment is necessary to continue the Department's effort in proactively
protecting and serving the residents and visitors to the City; and
WHEREAS, pursuant to Section 18-92 of the Code of the City of Miami, Florida, as amended
("City Code"), the Chief Procurement Officer has made a finding that WeatherBug is the sole source
provider of the WeatherBug Products and Services including Camera Systems, accessories and
related equipment; and
WHEREAS, the findings of the Chief Procurement Officer have been approved and adopted as
the findings of the City Manager; and
WHEREAS, the City Manager and the Chief Procurement Officer recommend that the
requirements for competitive formal sealed bidding procedures be waived and the purchase of five (5)

WeatherBug Cameras, accessories and related equipment from WeatherBug, as the sole source, be
approved;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. By a four-fifths (4/5ths) affirmative vote, pursuant to Section 18-92 of the City Code,
after an advertised public hearing, the City Manager's finding of a sole source is ratified, approved
and confirmed, the requirements for competitive sealed bidding procedures, approving the purchase
of five (5) WeatherBug Camera Systems, accessories and related equipment, from WeatherBug for
the Department for a purchase amount of $46,250.00, are waived, with funds allocated from the
Department's Urban Area Security Initiative Grant, Account Code No.
11100.189000.664000.0000.00000, subject to the availability of funds and budgetary approval at the
time of need, and the requirements for the competitive sealed bidding procedures for future
purchases of the WeatherBug Camera System, including replacements, improvements and integral
equipment, are waived, as long as WeatherBug remains a sole source as determined by the Chief
Procurement Officer.
Section 3. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor. {1 }
Footnotes:
{1} This Resolution shall become effective as specified herein unless vetoed by the Mayor within ten
(10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it
shall become effective immediately upon override of the veto by the City Commission or upon the
effective date, whichever is later.
