A RESOLUTION OF THE MIAMI CITY COMMISSION ACCEPTING THE
RECOMMENDATION OF THE CITY MANAGER REJECTING THE SINGLE
PROPOSAL RECEIVED IN RESPONSE TO THE DEPARTMENT OF REAL ESTATE
AND ASSET MANAGEMENT'S REQUEST FOR PROPOSALS ("RFP") NO.
14-15-024 FOR THE DEVELOPMENT AND LEASE OF THE NORTH RIVERFRONT
PROPERTY LOCATED AT 236 AND 298 SOUTHWEST NORTH RIVER DRIVE,
MIAMI, FLORIDA; AUTHORIZING THE CITY MANAGER TO ISSUE A NEW RFP,
INCLUSIVE OF CITY -OWNED SUBMERGED LAND REQUIREMENTS PURSUANT
TO ORDINANCE NO. 13540, AS AMENDED, AND UTILIZING SUCH
ADVERTISEMENT MEDIUMS DEEMED NECESSARY TO ATTRACT VARIOUS
COMPETING OFFERS AND REALIZE THE MOST FAVORABLE RETURN
POSSIBLE FOR THE CITY OF MIAMI.
WHEREAS, on June 15, 2015, the City of Miami ("City") Department of Real Estate and Asset
Management ("DREAM") issued Request for Proposals ("RFP") No. 14-15-024 for the development
and lease of the North Riverfront Property located at 236 and 298 Southwest North River Drive, Miami,
Florida; and
WHEREAS, on said date, the solicitation period commenced and the RFP was available for a total
duration of ninety-one (91) days thereafter; and
WHEREAS, on September 14, 2015, the solicitation period closed with a single proposal submitted
in response to the RFP; and
WHEREAS, contemporaneous with the solicitation's closure, City Ordinance No. 13540 was
enacted providing the City with the methods to directly negotiate and enter into leases or management
agreements for City -owned submerged land with entities having a possessory or ownership interest in
the abutting riparian uplands and providing the City with the methods and procedures by which it can
ensure that any such leases or management agreements result in a return to the City of at least fair
market value; and
WHEREAS, the City has not negotiated any rental amounts with the State for the submerged
lands and, thus, could not ensure said fair market value as required per law with the current RFP; and
WHEREAS, due to receipt of a single proposal, the City Manager has recommended rejection of
the same and issuance of a new RFP, inclusive of City -owned submerged land requirements pursuant
to Ordinance No. 13540, as amended, utilizing such advertisement mediums deemed necessary to
attract various competing offers and realize the most favorable return possible for the City;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The City Manager's recommendation rejecting the single proposal received in response

to DREAM RFP No. 14-15-024 for the development and lease of the North Riverfront Property located
at 236 and 298 Southwest North River Drive, Miami, Florida is hereby accepted.
Section 2. The City Manager is authorized {1} to issue a new RFP, inclusive of City -owned
submerged land requirements pursuant to Ordinance No. 13540, as amended, and utilizing such
advertisemeht mediums deemed necessary to attract various competing offers and realize the most
favorable return possible for the City.

Footnotes:
{1} The herein authorization is further subject to compliance with all requirements that may be imposed
by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code
provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
