A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE CITY
MANAGER TO NEGOTIATE AND EXECUTE AN AGREEMENT, IN A FORM
ACCEPTABLE TO THE CITY ATTORNEY, WITH MIAMI-DADE COUNTY
REGARDING THE ADMINISTRATION OF PROJECTS THAT REQUIRE
COMPLIANCE WITH THE DAVIS-BACON ACT, SECTION 1, TITLE 40 OF THE
UNITED STATES CODE, CHAPTER 31, SUBCHAPTER IV, AS AMENDED;
AUTHORIZING THE CITY MANAGER TO EXECUTE ANY AND ALL DOCUMENTS
NECESSARY, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID
PURPOSE.
WHEREAS, the City of Miami Department of Community and Economic Development
("Department") administers federally funded projects that must be in accordance with federal
regulations, including the Davis -Bacon Act, Section 1, Title 40 of the United States Code §3141 et
seq., as amended ("Davis -Bacon Act"); and
WHEREAS, some of the projects funded by the Department are also funded by government
agencies using their respective federal funds; and
WHEREAS, the Davis -Bacon Act requirements recommend intergovernmental cooperation; and
WHEREAS, Miami -Dade County has proposed to take the lead in intergovernmental cooperation
of federally funded projects; and
WHEREAS, the Department recommends entering into an agreement with Miami -Dade County
that ensures compliance with the Davis -Bacon Act requirements, as they may be amended from time
to time;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as fully set forth in this Section.
Section 2. The City Manager is authorized{1} to negotiate and execute an agreement, in a form
acceptable to the City Attorney, with Miami -Dade County regarding the administration of projects that
require compliance with the Davis -Bacon Act, and to execute any and all documents necessary, in a
form acceptable to the City Attorney, for said purpose.
Section 3. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{2}

{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter
and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
