HomeMy WebLinkAboutR-15-0489Vop City of Miami Legislation < U R �O Resolution: R-15-0489 File Number: 15-01365 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 11/19/2015 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), ESTABLISHING A NEW SPECIAL REVENUE PROJECT FOR FISCAL YEAR 2015-2016 ENTITLED "CHILD DAY CARE FOOD PROGRAM", AND ACCEPTING AND APPROPRIATING FUNDS, IN THE ESTIMATED AMOUNT NOT TO EXCEED $78,500.00, CONSISTING OF ENTITLEMENT FUNDING ON A REIMBURSEMENT BASIS FROM THE FLORIDA DEPARTMENT OF HEALTH, BUREAU OF CHILD CARE FOOD PROGRAMS, THROUGH ITS CHILD CARE FOOD PROGRAM ("CCFP") PERMANENT CONTRACT, ADMINISTERING FUNDS FROM THE UNITED STATES DEPARTMENT OF AGRICULTURE CHILD AND ADULT CARE FOOD PROGRAM, CFDA #10.558; AUTHORIZING THE CITY MANAGER TO ACCEPT SUCH ENTITLEMENT FUNDING ON A REIMBURSEMENT BASIS, AND TO EXECUTE THE NECESSARY DOCUMENTS, AMENDMENTS, EXTENSIONS, RENEWALS, AND MODIFICATIONS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, IN ORDER TO IMPLEMENT THE ACCEPTANCE OF AND COMPLIANCE WITH SAID ENTITLEMENT AWARD FOR THE OPERATIONS OF A YEAR-ROUND FOOD SERVICE PROGRAM LOCATED AT THE EATON PARK DAY CARE, LEMON CITY DAY CARE, AND MOORE PARK DAY CARE, FROM OCTOBER 1, 2015 THROUGH SEPTEMBER 30, 2016, WITH CONDITIONS AUTHORIZING THE EXPENDITURES OF FUNDS FOR THE OPERATIONS OF THE PROGRAM WITH SUCH AUTHORIZATION REMAINING VALID AND OUTSTANDING EVEN IF THE ANTICIPATED ENTITLEMENT AWARD IS REDUCED OR INCREASED, AND WITH THE OPTION TO RENEW ANNUALLY UNDER THE SAME TERMS AND CONDITIONS, SUBJECT TO BUDGETARY APPROVAL AT TIME OF NEED. WHEREAS, the City of Miami ("City") Department of Parks and Recreation sponsors a year-round Food Service Program ("Program") located at the Eaton Park Day Care, Lemon City Day Care, and Moore Park Day Care; and WHEREAS, the Florida Department of Health ("DOH"), Bureau of Child Care Food Programs ("State"), through its Child Care Food Program ("CCFP") Permanent Contract, as administrator for the United States Department of Agriculture ("USDA") Child and Adult Care Food Program, CFDA # 10.558, provides entitlement funding to the City to conduct the Program from October 1, 2015 through September 30, 2016; and WHEREAS, said entitlement funding is payable on a reimbursement basis in the estimated not to exceed amount of $78,500.00, based on attendance figures at the aforementioned locations and reimbursement rates, which may later be adjusted by the USDA or DOH; and WHEREAS, the USDA and the DOH have provided the form of the Permanent Contract from previous years, attached and incorporated, which continues in full force and effect and will be the form of the Permanent Contract used for Fiscal Year 2015-2016; City of Miand Page I of 3 File Id. 15-01365 (Version: 1) Printed On: 4/5/2018 File Number: 15-01365 Enactment Number: R-15-0489 NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble of this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The following new Special Revenue Project is established and resources are appropriated as described herein: PROJECT TITLE RESOURCES APPROPRIATION Child Day Care Food Program 2015-2016 Florida Department of Health, Bureau of Child Care Food $ 78,500.00 Programs, United States Department of Agriculture Child and Adult Care Food Program, CFDA #10.558 Child Day Care Food Program 2015-2016 $ 78,500.00 Section 3. The City Manager is authorized {1} to accept such entitlement funding on a reimbursement basis, and to execute the necessary documents, amendments, extensions, renewals, and modifications, in a form acceptable to the City Attorney, in order to implement the acceptance of and compliance with said entitlement award for the Operations of the Program located at the Eaton Park Day Care, Lemon City Day Care, and Moore Park Day Care, in the estimated not to exceed amount of $78,500.00, from October 1, 2015 through September 30, 2016, with the option to renew annually under the same terms and conditions, subject to budgetary approval at the time of need. Section 4. The expenditure of the entitlement funds are authorized for the operations of the Program, with such authorization remaining valid and outstanding even if the anticipated entitlement award is reduced or increased. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {2} Footnotes: City of Miami Page 2 of 3 File Id. 15-01365 (Version: 1) Panted On: 4/5/2018 File Number: 15-01365 Enactment Number: R-15-0489 {1 } The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
