A RESOLUTION OF THE MIAMI CITY COMMISSION DIRECTING THE CITY
MANAGER TO EXPLORE ANY AND ALL OPTIONS FOR CREATING A
HOUSING AUTHORITY AND/OR HOUSING DEPARTMENT AND TO PRESENT
A REPORT DETAILING THOSE OPTIONS IN SIXTY (60) DAYS TO THE CITY
COMMISSION; FURTHER DIRECTING THE CITY MANAGER TO CONDUCT A
WORKSHOP OR MEETING WITH THOSE ATTENDEES THAT HE DESIGNATES
TO DISCUSS ALL OPTIONS FOR CREATING A HOUSING DEPARTMENT
AND/OR HOUSING AUTHORITY.
WHEREAS, in the City of Miami ("City"), there exists unsanitary or unsafe dwelling
accommodations that persons of low income are forced to reside in; and
WHEREAS, within the City, there is a shortage of safe and sanitary dwelling
accommodations available at rents which persons of low income can afford; and
WHEREAS, such persons are often forced to occupy overcrowded and congested
dwelling accommodations; and
WHEREAS, said conditions cause an increase in and spread of disease and crime and
constitute a menace to the health, safety, morals, and welfare of the residents of the State of
Florida and impair economic values; and
WHEREAS, these conditions necessitate excessive and disproportionate expenditures
of public funds for crime prevention and punishment, public health, welfare and safety, fire and
accident protection, and other public services and facilities; and
WHEREAS, blighted areas in the City cannot be revitalized nor can the shortage of safe
and sanitary dwellings for persons of low income be relieved solely through the operation of
private enterprise; and
WHEREAS, clearance, re -planning, and reconstruction of the areas in which unsanitary
or unsafe housing conditions exist and the possibility of providing safe and sanitary dwelling
accommodations for persons of low income, including the acquisition by a housing authority of
property to be used for or in connection with housing projects or appurtenant thereto, are
exclusively public uses and purposes for which public money may be spent and private property
acquired are governmental functions of public concern; and
WHEREAS, pursuant to Section 421.04, Florida Statutes, the Florida Legislature has
created in each city of this state a public body corporate and politic to be known as the "Housing
Authority" of the city; and
WHEREAS, the Housing Authority of the City shall not transact any business or exercise
any powers endowed to it until or unless the governing body of the City, by proper Resolution,
shall declare that there is need for an authority to function in the City; and

WHEREAS, in lieu of enacting a Chapter 421, Florida Statutes, entitled "Housing
Authorities," the City may instead create another department dedicated exclusively to the
creation and administering of affordable housing within the City to solve the affordable housing
crisis; and
WHEREAS, there is a need to determine whether the City's affordable housing crisis is
best solved through the enactment of a Housing Authority pursuant to Chapter 421, Florida
Statutes, or the creation of a City Housing Department;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble of this Resolution are
adopted by reference and incorporated herein as if fully set forth in this Section.
Section 2. The City Manager is directed to present to the City Commission meeting a of
all options for creating a Housing Authority pursuant to Chapter 421, Florida Statutes, or a City
Housing Department in sixty (60) days.
Section 3. The City Manager is further directed to hold a workshop or meeting among
such attendees as he designates where all options for creating a Housing Authority pursuant to
Chapter 421, Florida Statutes, or creating a City Housing Department are presented and
discussed.
Section 3. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.'

1 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10)
calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it
shall become effective immediately upon override of the veto by the City Commission.
