HomeMy WebLinkAboutR-15-0469Vop City of Miami '"* Legislation < U R �O Resolution: R-15-0469 File Number: 15-01254 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 10/22/2015 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE AN ACCESS AGREEMENT ("AGREEMENT"), IN SUBSTANTIALLY THE ATTACHED FORM, WITH TEJERA TV, LLC ("COMPANY") TO ALLOW THE COMPANY TO FILM AT THE MIAMI POLICE DEPARTMENT, LOCATED AT 400 NORTHWEST 2ND AVENUE, MIAMI, FLORIDA, AND OTHER PREMISES WITHIN THE JURISDICTION OF THE CITY OF MIAMI; FURTHER AUTHORIZING THE CITY MANAGER TO DESIGNATE THE CHIEF OF POLICE TO EXECUTE ANY OTHER NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, IN ORDER TO FACILITATE ACCESS ON THE PREMISES CONSISTENT WITH THIS AGREEMENT AND ACCEPT CONTRIBUTIONS MADE PURSUANT TO THE AGREEMENT. WHEREAS, the intent of the Access Agreement ("Agreement") is to allow Tejera TV, LLC, ("Company") to film interior and/or exterior scenes in connection with the production of a television series depicting law enforcement events and related activities; and WHEREAS, the Company acknowledges and agrees that in order to protect the integrity of the City of Miami's ("City's") work, maintain the safety of its officers, the public and the Company's personnel, and to minimize liability to the City, the Company shall comply with all instructions and restrictions as directed by the City; and WHEREAS, any filming by the Company and the work of the Company's personnel shall not interfere in any manner whatsoever with the City's performance of its duties; and WHEREAS, the Company shall make monetary contributions payable to the Miami Police Athletic League, Inc. and/or, as may otherwise be directed, to benevolent local law enforcement causes; and WHEREAS, the Company agrees that, to the extent reasonably possible, subject to artistic considerations, contract requirements and the preferences of aligned networks and distributors, the Company shall use best efforts to hire and/or engage local personnel, crews, vendors and contractors with the requisite capacities and experience, for the purpose of advancing additional employment and job creation; and WHEREAS, the Company shall be entitled to film at the location commencing on the date of execution of the Agreement and continuing to and including September 30, 2018; and WHEREAS, upon mutual agreement of the City and the Company, the term of the Agreement may be extended for four (4) additional one (1) year periods; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: City of Miand Page 1 of 2 File Id. 15-01254 (Version: 1) Printed On: 4/3/2018 File Number: 15-01254 Enactment Number: R-15-0469 Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized{1} to execute an Agreement, in substantially the attached form, with the Company to allow the Company to film at the Miami Police Department located at 400 Northwest 2nd Avenue, Miami, Florida, and other premises within the jurisdiction of the City, and to designate the Chief of Police to execute any other necessary documents, in a form acceptable to the City Attorney, in order to facilitate access on the premises consistent with this Agreement and accept contributions made pursuant to the Agreement. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
