HomeMy WebLinkAboutLegislationFile Number: 15-01236 City Hall 3500 Pan American Drive Miami FL 33133 www.miamigov,com Final Action ?ate: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE A GRANT OF AN UNDERGROUND EASEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, GRANTING FLORIDA POWER AND LIGHT COMPANY, A FOR-PROFIT FLORIDA CORPORATION ("FPL"), A PERPETUAL, NON-EXCLUSIVE UNDERGROUND EASEMENT OF A PORTION OF CITY -OWNED PROPERTY LOCATED BETWEEN 3501 RICKENBACKER CAUSEWAY, MIAMI, FLORIDA, AND 3511 RICKENBACKER CAUSEWAY, MIAMI, FLORIDA, AND LOCATED AT THE MIAMI MARINE STADIUM PROJECT, ENCLOSING A FPL DUCT BANK ("FPL DUCT BANK"), AS MORE PARTICULARLY DESCRIBED IN EXHIBIT "A", ATTACHED AND INCORPORATED, FOR THE CONSTRUCTION, OPERATION AND MAINTENANCE OF ELECTRIC UTILITY FACILITIES, WITH THE RIGHT TO RECONSTRUCT, IMPROVE, ADD TO, ENLARGE, CHANGE THE VOLTAGE OF, AND THE SIZE OF AND REMOVE ALL OR ANY OF THE FACILITIES WITHIN SAID EASEMENT. WHEREAS, Florida Power& Light Company, a for-profit Florida Corporation ("FPL"), has requested a grant of an underground easement of an area of City of Miami ("City") owned property Located between 3501 Rickenbacker Causeway, Miami, Florida, and 3511 Rickenbacker Causeway, Miami, Florida and located at the Miami Marine Stadium Project ("Property") enclosing a FPL Duct Bank ("FPL Duct Bank"); and WHEREAS, this underground easement will be used to construct, operate and maintain electric utility facilities, including wires, guys, cables, conduits, and appurtenant equipment, to be installed from time to time to service exclusively the City -owned Property, with the right to reconstruct, improve, add to, enlarge, change the voltage of, change the size of and remove such facilities or any of them within said underground easement, with full right of ingress thereto and egress therefrom; and WHEREAS, the underground easement is necessary in order to bring electrical service to the City -owned Property; NOW, THEREFORE, BE IT RESOLVED BY T HE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. The City Manager is authorized{1} to execute an underground grant of easement, in substantially the attached form, granting FPL a perpetual non-exclusive underground easement of a portion of City -owned Property known as the FPL Duct Bank, as more particularly described in Exhibit "A", attached and incorporated, for the construction, operation, and maintenance of electric utility facilities, with the right to reconstruct, improve, add to, enlarge, change the voltage of, change the size of and remove all or any of the facilities within said underground easement. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
