HomeMy WebLinkAboutO-13569Vop City of Miami F .. , 'Ir* Legislation i 0 R �O Ordinance: 13569 File Number: 15-01232 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 10/22/2015 AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER 10/ARTICLE I, OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED "BUILDINGS/IN GENERAL", MORE PARTICULARLY BY ADDING A NEW SECTION 10-7, ENTITLED "MINIMUM REQUIREMENTS FOR CONTRACTORS", CREATING REQUIREMENTS FOR PROVIDING NOTICE AND CONTACT INFORMATION FOR CONTRACTORS IN CONNECTION WITH CONSTRUCTION; CONTAINING A REPEALER PROVISION, A SEVERABILITY CLAUSE, AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, from time to time the City of Miami ("City") receives complaints by neighboring residents as to the conduct and practices of contractors building or rehabilitating buildings in the City; and WHEREAS, the City Commission deems it advisable to protect the health, safety and welfare of those who live in close proximity to these construction sites by requiring contractors to post contact information; and WHEREAS, requiring contact information where aggrieved neighbors can contact contractors will hold the same to a higher level of accountability; and WHEREAS, requiring contractors to affirm that they will operate ethically when doing business in the City will result in fewer complaints from neighboring residents affected by the construction, demolition or rehabilitation, of a building; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Chapter 10 of the Code of the City of Miami, as amended, is amended in the following particulars:{1 } "CHAPTER 10 BUILDINGS ARTICLE I. - IN GENERAL c. 10-7.- Minimum reauirements for contractors. Prior to the issuance of a building permit for a structure to be built, constructed, or demolished, City of Miand Page 1 of 3 File Id. 15-01232 (Version: 2) Printed On: 3/29/2018 File Number: 15-01232 Enactment Number: 13569 except for city unsafe structure demolitions, the contractor for such construction or demolition shall, prior to the commencement of any work, sign a Contractor's Code of Ethics which shall be affixed to the building permit and shall read in substantially the attached form: 1. I will be fair, honest, impartial, respectful and professional, and act in good faith in all my business relationships with my clients and the public, including employees, subcontractors and suppliers. 2. 1 will always act in the interests of the client unless doing so violates an ordinance, statute or this Code of Ethics. 3. 1 will not discriminate in anv business activities on the basis of race. national oriain. religion, gender, sexual orientation, familial status or handicap, and will comply with all federal, state and local laws concerning discrimination and fair housing. 4. 1 will be truthful regarding my training, experience, qualifications and services. 5. 1 will be truthful regarding my licenses and certifications, and will provide documentation upon request. 6. 1 will be truthful regarding my bonding and insurance coverage. 7. 1 will acceat onlv assianments and aroiects for which my skills and licensina are commensurate 8. 1 will uphold and comply with all applicable statute, laws, ordinances, codes, and professional licensing requirements of the jurisdiction in which I conduct business, especially those related to safety. For any lot or site on which a structure is being built, constructed, or demolished, except for city unsafe structure demolitions, the contractor for such construction or demolition, prior to the commencement of any work, shall provide the following: (a) A posted notice, not to exceed four (4) square feet, attached to a temporary construction fence, or staked into the ground, and visible from the public right of way, at a minimum 168 -point type that shall read in substantially the attached form: THIS IS AN ACTIVE CONSTRUCTION SITE. THE CONTRACTOR IS [insert contractorl. FOR ANY COMPLAINTS OR CONCERNS PLEASE CALL [insert telephone numberl OR E-MAIL [insert e-mail addressl. A contractor may incorporate this required language into an already existing sign at the lot or site provided the requirements above are followed. The contractor, if a corporate entity, shall provide its registered name, and not a fictitious name on the notice. (c) The telephone number provided must be active and answered by a live person from 9 a.m. to 5 p.m. on weekdays, or at any time during active construction activity, whichever is greater. The e-mail address provided must be active and all complaints or concerns regarding the site acknowledged within twenty-four (24) hours of receipt. (e) Enforcement of this section shall be as proscribed by Chapter 2, Article X, Code Enforcement. and anv other remedies as provided by law. Secs. 10-78-10-20. - Reserved. Section 2. All Ordinances or parts of Ordinances that are inconsistent or in conflict with the provisions of this Ordinance are repealed. If any section, part of a section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 4. This Ordinance shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: {1} Words/and or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and unchanged material. {2} This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten (10) days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later.
