Subject: D2 unrestricted definition
"Unrestricted" is not defined. We then rely on the plain English meaning of the word. Webster's
defines "restricted" as "allowing use or entry by only certain people". "Un" means not. Therefore
"unrestricted" means "not allowed for use".
I don't see how this legislation could allow for the invasion of the existing parking trust funds.
Those funds primarily get their money from payments by applicants seeking to pay rather than
provide spaces. As written, this ordinance requires that unrestricted one-time payments of
>$500k go to capital. Money earmarked or given to the design district or grove trust funds would
be restricted. The ordinance also requires 20% of every cash contribution public benefits trust
fund in Ch.62 / Miami2l (except for affordable housing). The Grove and Design District trust
funds are not mentioned in Miami2l except for one inapplicable section regarding adaptive
reuse. They are in Ch. 35 so it is clear that money will not come out of those funds.
