HomeMy WebLinkAboutLegislation (v1)f* City of Miami r Legislation Resolution File Number: 15-01028ww City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), MAKING FINDINGS AND APPROVING ELIMINATING PUBLIC ACCESS TO A PORTION OF BAYWALK WITHIN THE MIAMI BAY CLUB PROJECT TO BE LOCATED AT APPROXIMATELY 601 NORTHEAST 39 STREET, MIAMI, FLORIDA. WHEREAS, on July 31, 2015, Iris V. Escarra, on behalf of Miami Bay Trust, LLC, submitted a request for a special appearance to request permission to close access to the public of a baywalk being built as part of the Miami Bay Club project to be located at 601 NE 39 Street; WHEREAS, this request to eliminate public access to a portion of the baywalk within the project is subject to City Commission approval pursuant to Section 3(mm)(iii) of the Charter of the City of Miami, Florida, as amended ("Charter"); WHEREAS, the City Commission has considered the applicant's request and deems it advisable and in the best interest of the general welfare of the City of Miami ("City") to approve eliminating public access to a portion of the baywalk within the project; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. The City Commission hereby finds that the Miami Bay Club project complies with the criteria found in Section 3(mm)(iii) of the Charter and Article 3, Section 3.11 of Miami 21, and hereby eliminates public access to a portion of the public baywalk located within the Miami Bay Club project to be located at approximately 601 NE 39 Street, Miami, Florida, legally described in "Exhibit A ", attached and incorporated. Section 3. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
