Background of Item: As part of the FDOT's SW 1 st Street Bridge replacement project, two sections of the Miami River Greenway will be constructed on the north and south sides of the Miami River. The proposed work are non-standard improvements consistent with the River Greenway Design Guidelines. As such the FDOT requires the City to maintain the subject improvements once they have been constructed. WHEREAS, the City of Miami ("City") seeks to establish a Maintenance Memorandum of Agreement ("Agreement"), in substantially the attached form, with the Florida Department of Transportation for landscape, turf, integral colored sidewalks, pavers, aggregate textured sidewalks, lighting systems and other incidental features on State Road 968/Southwest 1 st Street from Southwest 6t" Avenue to Southwest 2nd Avenue, Miami, Florida, and other certain parcels ("Project"), as more particularly described in Exhibits "A," "B," and "C" of the Agreement; and WHEREAS, pursuant to the design plans for the Project, FDOT will install landscape, turf, integral colored sidewalks, pavers, aggregate textured sidewalks, lighting conduits, and pull -boxes and the City will install, under a future permit, lighting system(s), bollards, benches, trash receptacles, and signage with specific terms, conditions, and responsibilities of FDOT and the City as more fully described in in the Agreement; and WHEREAS, the terms of the Agreement, in substantially the attached form, are acceptable to the City Administration; and WHEREAS, it is requested that the City Commission authorize the City Manager to execute said Agreement and to make any non -substantive amendments to the Agreement, in a form acceptable to the City Attorney, for said purpose; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized' to execute the FDOT Agreement, in substantially the attached form, for the Project, with terms and conditions as more particularly described in the Agreement. Section 3. The City Manager is further authorized' to make non -substantive amendments to the Agreement, in a form acceptable to the City Attorney, for said purpose. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: 1 i ria i ndez, City Attor iey 12/412017 ' The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to, those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
