HomeMy WebLinkAboutR-15-0351Vop City of Miami '"* Legislation < U R �O Resolution: R-15-0351 File Number: 15-00984 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 9/10/2015 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE A VOLUNTARY COOPERATION MUTUAL AID AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, APPROVING THE CITY OF MIAMI POLICE DEPARTMENT'S CONTINUED PARTICIPATION IN THE SOUTH FLORIDA MONEY LAUNDERING STRIKE FORCE, CONSISTING OF THE MIAMI-DADE STATE ATTORNEY'S OFFICE AND OTHER PARTICIPATING LAW ENFORCEMENT AGENCIES, TO COMBAT ILLEGAL MONEY LAUNDERING, DRUG TRAFFICKING, RELATED CRIMINAL VIOLATIONS, AND TO DISRUPT ORGANIZATIONS ENGAGING IN SUCH ACTIVITY THROUGH COORDINATED AND LONG-TERM INVESTIGATIVE, FORFEITURE, AND PROSECUTION EFFORTS, PURSUANT TO THE AUTHORITY UNDER PART 1, CHAPTER 23, OF THE FLORIDA STATUTES, "THE FLORIDA MUTUAL AID ACT". WHEREAS, Resolution No. 12-0292, adopted September 13, 2012, authorized the City Manager to execute a Voluntary Cooperation Mutual Aid Agreement, on behalf of the City of Miami Police Department ("MPD") and with the State Attorney's Office for the Eleventh Judicial Circuit in and for Miami -Dade County ("SAO"), to participate in the South Florida Money Laundering Strike Force ("Strike Force") which will expire on or about September 1, 2015; and WHEREAS, the Strike Force is a collaboration with multiple law enforcement agencies to combat illegal money laundering, drug trafficking, drug law violations and related criminal investigations, and to disrupt organizations engaging in such activity through coordinated and long-term investigative, forfeiture, and prosecution efforts; and WHEREAS, the City of Miami ("City") and the SAO now wish to execute a new successor Voluntary Cooperation Mutual Aid Agreement to continue MPD's participation in the Strike Force commencing on September 1, 2015, and ending on September 1, 2018; and WHEREAS, the SAO requires all law enforcement agencies approved and authorized as a member of the Strike Force to enter into this agreement in order to participate in the Strike Force for the purposes and goals set forth in the agreement; and WHEREAS, as a member of the Strike Force, MPD will have an opportunity to participate in the distribution of any forfeiture funds recovered by the Strike Force; and WHEREAS, the City is authorized by Part I, Chapter 23, Florida Statutes "the Florida Mutual Aid Act," to enter into voluntary cooperation agreement for collaboration and assistance of a routine law enforcement nature that crosses jurisdictional lines; City of Miand Page 1 of 2 File Id. 15-00984 (Version: 1) Printed On: 3/21/2018 File Number: 15-00984 Enactment Number: R-15-0351 NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA; Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized {1} to execute a new Voluntary Cooperation Mutual Aid Agreement, in substantially the attached form, with the SAO and other participating law enforcement agencies, to participate in the Strike Force, thereby extending and receiving mutual aid in the form of law enforcement services and resources to combat illegal money laundering, drug trafficking, related criminal violations, and to disrupt organizations engaging in such activity pursuant to the "The Florida Mutual Aid Act" under part 1, Chapter 23, of the Florida Statutes. Section 3. This Resolution shall become effective immediately upon its adoption and the signature of the Mayor. {2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
