HomeMy WebLinkAboutR-15-0309Vop City of Miami Legislation < U R �O Resolution: R-15-0309 File Number: 15-00799 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 7/23/2015 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE MUTUAL AID AGREEMENTS, IN SUBSTANTIALLY THE ATTACHED FORM, BETWEEN THE CITY OF MIAMI AND THE FOLLOWING MUNICIPALITIES: TOWN OF BAY HARBOR ISLANDS, VILLAGE OF EL PORTAL, CITY OF HIALEAH GARDENS, INDIAN CREEK VILLAGE, TOWN OF MEDLEY, CITY OF MIAMI SPRINGS, CITY OF SUNNY ISLES BEACH, TOWN OF SURFSIDE, BAL HARBOUR VILLAGE, FLORIDA CITY, VILLAGE OF BISCAYNE PARK AND VILLAGE OF VIRGINIA GARDENS, TO RECEIVE AND EXTEND MUTUAL AID IN THE FORM OF LAW ENFORCEMENT SERVICES AND RESOURCES TO ENSURE PUBLIC SAFETY AND ADEQUATELY TO RESPOND TO INTENSIVE SITUATIONS, INCLUDING, BUT NOT LIMITED TO NATURAL AND MAN-MADE DISASTERS OR EMERGENCIES AS DEFINED IN THE FLORIDA MUTUAL AID ACT, PURSUANT TO PART 1, CHAPTER 23 OF THE FLORIDA STATUTES. WHEREAS, because of the existing and continuing possibility of the occurrence of law enforcement problems and other natural and man-made conditions which are, or are likely to be, beyond the control of the services, personnel, equipment, or facilities of the City of Miami ("City") Department of Police or the police departments of the following municipalities: Town of Bay Harbor Islands, Village of EI Portal, City of Hialeah Gardens, Indian Creek Village, Town of Medley, City of Miami Springs, City of Sunny Isles Beach, Town of Surfside, Bal Harbour Village, Florida City, Village of Biscayne Park and Village of Virginia Gardens ("Participating Municipalities"); and WHEREAS, to ensure that preparation of these law enforcement agencies will be adequate to address any and all of these conditions, to protect the public peace and safety, and to preserve the lives and property of the people of the City and the Participating Municipalities; and WHEREAS, the City and the Participating Municipalities have the authority under the Florida Mutual Aid Act, Part 1, Chapter 23 of the Florida Statutes, to enter into mutual aid agreements; and WHEREAS, the City and the Participating Municipalities have the authority under the Florida Interlocal Cooperation Act of 1969, §163.01 Florida Statutes, to enter into interlocal agreements to jointly exercise any power, privilege or authority which they share in common and which each might exercise separately; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized{1} to execute Mutual Aid Agreements, in City of Miand Page 1 of 2 File Id. 15-00799 (Version: 1) Printed On: 3/16/2018 File Number: 15-00799 Enactment Number: R-15-0309 substantially the attached form, between the City and the Participating Municipalities, to receive and extend mutual aid in the form of law enforcement services and resources to ensure public safety and to adequately respond to intensive situations, including, but not limited to, natural or man-made disasters or emergencies as defined in the Florida Mutual Aid Act, pursuant to Part 1, Chapter 23 of the Florida Statutes. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: {1) The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
