SUBJECT: Gift Agreement

The Department of Resilience and Sustainability respectfully requests your approval and action of
the Miami City Commission by a 4/5ths affirmative vote, after an advertised public hearing ratifying,
approving, and confirming the City Manager's recommendation, and finding that competitive
negotiation methods are not practicaNe or advantageous regarding the agreement for the receipt
of in in-kind service donation for a new general design of Jose Marti Park to address flood risk in
the Little Havana area.
The Department respectfully requests such recommendation, finding, and authorization in order to
proceed with executing a Gift Agreement with Van Alen Institute ("VAI"), who is a non-profit
organization that collaborates with communities, scholars, policymakers, and professionals on
local and global initiatives to rigorously investigate the most pressing social, cultural, and ecological
challenges of tomorrow. VAI has agreed to gift the City approximately one -hundred and twenty
thousand dollars ($120,000.00) in-kind services for a new general design of Jose Marti Park to
address increasing flood risks associated with sea level rise. VAI will gift the City sixty thousand
dollars ($60,000 00) in monetary funds to solely be utilized to compensate the Selected Proposer,
resulting from the City:s RFQ, for the development of conceptual designs for Jose Marti Park.
For the reasons stated above, as required by Section 15-85 of the Code of the City of Miami, the
Department of Resilience and Sustainability ( 1) recommends the execution of a Gift Agreement
with VAI, and (2) finds that competitive negotiation methods are not practicable or advantageous
for the acceptance of this in-kind donation.

This legislation item will be placed on the agenda for November 16, 2017 City Commission
meeting.
