Purpose of Item: A RESOLUTION OF THE MIAMI CITY COMMISSION, BY A FOUR-FIFTHS (4/5THS) AFFIRMATIVE VOTE, AFTER AN ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING, AND CONFIRMING THE CITY MANAGER'S FINDING THAT COMPETITIVE NEGOTIATION METHODS AND PROCEDURES ARE NOT PRACTICABLE OR ADVANTAGEOUS, PURSUANT TO SECTION 18-85(A) OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED; WAIVING THE REQUIREMENTS FOR SAID PROCEDURES; AUTHORIZING THE ALLOCATION OF FUNDS, IN THE AMOUNT OF $155,184 TO ALLAPATTAH COMMUNITY ACTION, INC; FOR PUBLIC SERVICES ACTIVITIES; WITH FUNDS ALLOCATED FROM THE SOCIAL SERVICES GAP PROGRAM FUND, ACCOUNT NO. 00001.910101.882000; AUTHORIZING THE CITY MANAGER TO EXECUTE ANY AND ALL THE AGREEMENT(S), IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, WITH SAID AGENCY, FOR SAID PURPOSE. Background of Item: Due to the continuous decrease of available Community Development Block Grant funds in the last few years, Public Services agencies' allocations have been reduced resulting in reduction of services to residents. The City Commission wishes to allocate funding to cover public service program shortfalls for fiscal year 2017-2018 from the Social Services Gap Program fund, account No. 00001.910101.882000. On September 28, 2017, the City of Miami Commission approved a contribution from General Funds; which includes an amount of $743,000 for Public Services activities. Allapattah Community Action, Inc., agency is a non -for-profit organization that has been in service to the community for more than 30 years and provides food to low and moderate -income seniors in the Allapattah area. The City Manager has made a finding that pursuant to Section 18-85(a) of the Code of the City of Miami, Florida, as amended ("City Code"), competitive negotiation methods and procedures are not practicable or advantageous to the City for obtaining said services, and has recommended to the City Commission that the findings be adopted and that competitive bidding methods and procedures be waived for the Program. The City administration recommends the allocation of funds in the amount of $155,184 from the Social Services Gap Program to Allapattah Community Action, Inc. WHEREAS, due to the continuous decrease of available Community Development Block Grant funds in the last few years, Public Services agencies' allocations have been reduced resulting in a reduction of services to City of Miami ("City") residents; and WHEREAS, the City Commission wishes to allocate funding to cover public service program shortfalls for Fiscal Year 2017-2018 from the Social Services Gap Program ("SSG"), Account No. 00001.910101.882000; and WHEREAS, Allapattah Community Action, Inc., a Florida not for profit corporation ("Allapattah Community Action"), has served the community for more than thirty (30) years and provides food services to low and moderate income seniors ("Program"); and WHEREAS, the City Manager has made a finding, attached and incorporated as Attachment "A," that pursuant to Section 18-85(a) of the Code of the City of Miami, Florida, as amended ("City Code"), competitive negotiation methods and procedures are not practicable or advantageous to the City for obtaining said services and has recommended to the City Commission that the finding, attached and incorporated as Attachment "A," be adopted and that competitive bidding methods and procedures be waived for the Program; and WHEREAS, the City Administration recommends the allocation of funds in the amount of $155,184.00 from the SSG to Allapattah Community Action for the Program; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. By a four-fifths (4/5ths) affirmative vote, after an advertised public hearing, the City Manager's finding, attached and incorporated as Attachment "A," that competitive negotiation methods and procedures are not practicable or advantageous to the City pursuant to Section 18-85(a) of the City Code and waiving the requirements for said procedures, is ratified, approved, and confirmed. Section 3. The City Manager is authorized' allocate grant funds in an amount not to exceed $155,184.00 to Allapattah Community Action for Public Services activities with said funds to be allocated from SSG, Account No. 00001.910101.882000. Section 4. The City Manager is authorized' to execute any and all agreements, in a form acceptable to the City Attorney, with Allapattah Community Action, for the Program. Section 5. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
