Background of Item: The City of Miami ("City") and Downtown Development Authority ("DDA") applied for and were awarded a federal grant for the Biscayne Green Lane Elimination Analysis Project. FDOT will serve as the pass through agency for the federal funds. A LAP Agreement with FDOT will be required in order to access the funding award. The Biscayne Green Lane Elimination Analysis Project will provide essential pedestrian safety and accessibility improvements at seven (7) Metromover stations. Currently, the Biscayne Green Lane Elimination Analysis Project is included in FDOT's five year work program. The City Manager requests authority to accept the funds and execute the necessary LAP Agreement. Funds are to be appropriated by separate Resolution(s) for a total allocation of $421,829.00, for the Biscayne Green Elimination Analysis along Biscayne Boulevard from SE 1st Street to NE 6th Street Project. WHEREAS, the City of Miami ("City") and the Downtown Development Authority ("DDA") applied for and were awarded a federal grant for the Biscayne Green Lane Elimination Analysis Project ("Biscayne Green Project"); and WHEREAS, the Florida Department of Transportation ("FDOT") will serve as the pass- through agency for these federal funds and a Local Agency Participation ("Agreement") will be required in order to access the grant funding; and WHEREAS, the scope of work consists of the analysis, design, and implementation of the Biscayne Green Project, including providing essential pedestrian safety and accessibility improvements at seven (7) Metromover stations; and WHEREAS, a Grant Funds were awarded in the amount of $421,829.00 for the Biscayne Green Project, which applies to Biscayne Boulevard from Southeast 1 st Street to Northeast 6th Street; and WHEREAS, the Grant Funds are currently included in the FDOT Five (5) Year Work Program; and WHEREAS, the City Manager requests authority to accept the Grant Funds and to execute the Agreement, in substantially the attached form, in order to implement the acceptance of said grant award funding; and WHEREAS, funds are to be appropriated by separate resolution(s); NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized' to accept the grant awarded by FDOT in the amount of $421,829.00 with funds to be appropriated by separate resolution for the implementation of the Biscayne Green Project. Section 3. The City Manager is authorized' to execute the Agreement, in substantially the attached form, with FDOT for the Biscayne Green Project, which applies to Biscayne Boulevard from Southeast 1 st Street to Northeast 6th Street. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: 1 Una ndeU ez, City Attor ey 7/18/2017 'The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to, those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
