HomeMy WebLinkAboutR-17-0038City of Miami Legislation Resolution R-17-0038 File Number: 1531 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 1/26/2017 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), ESTABLISHING A NEW SPECIAL REVENUE PROJECT ENTITLED "2016-2017 U.S. MARSHALS SERVICE", AUTHORIZING THE CITY MANAGER TO EXECUTE A MEMORANDUM OF UNDERSTANDING AND OBLIGATION DOCUMENT, IN SUBSTANTIALLY THE ATTACHED FORM, FOR ACCEPTANCE OF REIMBURSEMENT FUNDS IN THE AMOUNT OF $100,000.00, FOR THE CITY OF MIAMI POLICE DEPARTMENT'S PARTICIPATION IN THE REGIONAL FUGITIVE TASK FORCE; FURTHER AUTHORIZING THE CITY MANAGER TO ACCEPT FUTURE FUNDING AND DESIGNATE THE CHIEF OF POLICE TO EXECUTE ANY OTHER NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, IN ORDER TO IMPLEMENT THE ACCEPTANCE OF SAID REIMBURSEMENT FUNDS. WHEREAS, the United States Marshals Service ("USMS") has requested that the City of Miami ("City") Police Department ("MPD") enter into a Memorandum of Understanding ("MOU") along with an Obligation Document, in substantially the attached form, to enhance the effectiveness of federal, state and local law enforcement resources through a well -coordinated effort to locate and apprehend fugitives; and WHEREAS, the USMS Regional Fugitive Task Force ("Task Force") is a multi -agency operation to investigate and apprehend local, state and federal fugitives who have committed dangerous crimes, including violent crimes against persons, weapons offenses, felony drug offenses, failure to register as a sex offender, and crimes committed by subjects who have a criminal history involving violent crimes; and WHEREAS, the intent of this Task Force is to improve public safety and reduce violent crime; and WHEREAS, the USMS has obligated reimbursement funding, in an amount up to $100,000.00, for MPD officers' participation in the Task Force from October 19, 2016 to September 30, 2017; and WHEREAS, reimbursements of the funds are subject to the availability of funds and contingent upon the submission of proper documentation by MPD; and WHEREAS, the funding is to be applied toward reimbursement of overtime expenses as well as expenses incurred for travel, training, and equipment by MPD investigators who provide full time support to the Task Force; and WHEREAS, no matching funds are required from the City; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: City of Miami Page 1 of 2 File ID: 1531 (Revision:) Printed On: 5/9/2017 File ID: 1531 Enactment Number: R-17-0038 Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The following Special Revenue Project is established and resources are appropriated as described below: FUND TITLE: 2016-2017 U.S. Marshals Service RESOURCES: United States Department of Justice-USMS $100,000.00 APPROPRIATIONS: Joint Law Enforcement Operations Task Force $100,000.00 Section 3. The City Manager is authorized' to execute a MOU along with an Obligation Document, in substantially the attached form, for acceptance of reimbursement funds in the amount of $100,000.00, for MPD's participation in the USMS Regional Task Force. Section 4. The City Manager is further authorized' to accept future funding and designate the Chief of Police to execute any other necessary documents, in a form acceptable to the City Attorney, in order to implement the acceptance of said reimbursement funds. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: 1 "na dez, City Attor ey 1/17/2017 ' The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney including but not limited to those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted.
