HomeMy WebLinkAboutR-88-00651J2�288/87 RESOLUT ION NO. 98-65 A RESOLUTION AUTHORIZING THE CITY MANAGER TO PURCHASE TWO (2) PARCELS (PARCEL Nos. 04-05 AND 04-06) LOCATED WITHIN THE WYNWOOD COMMUNITY DEVELOPMENT TARGET AREA, FOR THE PURPOSE OF DEVELOPING HOUSING AFFORDABLE TO LOW AND MODERATE I14COME FAMILIES IN CONNECTION WITH THE CITY SPONSORED SCATTERED SITE AFFORDABLE HOUSING DEVELOPMENT PROGRAM, IN ACCORDANCE WITH RESOLUTION NO. 77-73; FURTHER AUTHORIZING THE CITY ATTORNEY TO PROCEED TO CLOSE ON THE SUBJECT PARCELS AFTER EXAMINATION OF THE ABSTRACT AND CONFIRMATION OF OPINION OF TITLE. WHEREAS, the City Commission by Resolution No. 86-840 approved implementation of the Scattered Site Affordable Housing Development Program in the City's Community Development Target Areas for the purpose of providing owner -occupied residential units within the affordability range of qualified low and moderate income purchasers; and WHEREAS, the City, serving as housing developer, plans to finance the development of owner -occupied residential units in the Wynwood neighborhood; and WHEREAS, the City Commission through Resolution No. 87-455, authorized the acquisition of eight (8) parcels within the Wynwood Community Development Target area for the Program; and WHEREAS, funds in the amount of $1,000,000 are available from Ilth Year Community Development Block Grant funds for acquisition of the subject properties; and WHEREAS, the City Manager has secured negotiated purchase agreements with the owners of two (2) parcels in the Wynwood Community Development Target area and are identified and described in Exhibit A attached hereto and made a part hereof; and WHEREAS, the amounts set forth in Exhibit A are reasonable and in keeping with the costs of acquiring property through the normal negotiation process; and WHEREAS, the City Commission previously established a policy under Resolution NO. 77-73, to provide a bonus over the aDDraised ATTACHMENTS INCLOSED CITY COMMISSION MEETING OF mAR as ft 8865 value to owners who sell their property to the City through a negotiated settlement in lieu of condemnation; and WHEREAS, the City Commission through Resolution No. 87-455, directed the City Manager to notify by mail all property owners within 375 feet of the property lines of those parcels being acquired of a Public Hearing for the purpose of securing City Commission approval of each acquisition prior to the City i Attorney closing on each subject parcel after examination of the -� abstract and confirmation of Opinion of Title; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. This Commission hereby finds, determines, and declares that the matters set out in the foregoing recitals are true and correct and they are hereby incorporated by reference as if fully set forth in this section. Section 2. The City Manager is hereby authorized to execute the Agreements of Purchase and Sale of the subject properties identified at the costs stated in Exhibit A in connection with the City's Scattered Site Affordable Housing Development Program, subject to the availability of funds provided for in the foregoing paragraph. The City Attorney is hereby authorized then to proceed to close on said properties after examination of the abstract and confirmation of an Opinion of Title. - 2 - 89--�5 ul PASSED AND ADOPTED this 14th day of January ► 1988. Odio City Manager DATE: �rI�^^� FILE: Resolution Authorizing sueJEcT: Acquisition of Parcels in Wynwood REFERENCES: City Commission Agenda Item - January 14, 1988 ENCLOSURES: It is respectfully recommended that the City Commission adopt the attached resolution authorizing the purchase of two (2) parcels in the Wynwood Community Development Target Area for the purpose of developing affordable sales housing in connection with the City sponsored Scattered Site Affordable Housing Development Program. BACKGROUND: The Housing Conservation and Development Agency recommends ratification of the attached resolution which authorizes the purchase of two (2) parcels in the Wynwood Community Development Target Area for the purpose of developing affordable sales housing in the Wynwood neighborhood. The proposed resolution authorizes and directs the City Manager to execute an Agreement of Purchase and Sale for each of the subject parcels currently under consideration for acquisition. In October of 1986, through Resolution No. 86-840, the City Commission approved the implementation of the City's Scattered Site Affordable Housing Development Program in the City's Community Development Target Area for the purpose of providing owner occupied _ residential units within the affordability range of qualified low and moderate income purchasers. In addition, the City Commission authorized the City Manager to proceed in securing appraisals of home sites with initial emphasis in the Allapattah, Model City, Wynwood and Overtown target areas. In May pf 1987, the City Commission passed and adopted Resolution No. 87-455, which authorized the City Manager to make offers to property owners for acquisition of eight (8) parcels in the Wynwood Community Development Target Area for the Program. Subsequently, purchase offers were made to the owners of eight (8) parcels in the Wynwood neighborhood of which two (2) owners have agreed to sell their properties to the City through a negotiated purchase. 76-I . 6-65 Resolution Authorizing Acquisitions of Parcels in Wynwood Page - 2 - $1,000,000 in Community Development Block Grant funding previously authorized by the City Commission for the acquisition of home sites in connection with the Program is available to fund the cost of acquiring the parcels. In an effort to expedite the development of single family homes affordable to low and moderate income families in the Wynwood neighborhood, it is recommended that the City Commission approve the attached resolution. d .9Q"'6r
