F48--33 A RESOLUTION RATIFYING, APPROVING AND CONFIRMING THE ACTION OF THE CITY MANAGER IN WAIVING THE CITY'S RIGHT TO CERTAIN REVENUES THAT WOULD HAVE BEEN DUE TO THE CITY FROM THE SALE OF BEER AND ALCOHOL IN THE ORANGE BOWL STADIUM DURING THE 1988 ORANGE BOWL CLASSIC. BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The action of the City Manager in executing the attached Letter Agreement providing for a waiver of the City's right to certain revenues that would have been due to the City from the sale of beer and alcohol in the Orange Bowl Stadium during the 1988 Orange Bowl Classic is hereby ratified, approved and confirmed. The purpose of this agreement is to accommodate the Orange Bowl Committee's desire to prohibit beer and alcohol sales at the Orange Bowl during the 1988 Orange Bowl Classic. In order to effectuate the Orange Bowl Committee's desire, the parties agree to the following: (i) The City of Miami agrees to waive the revenues it would have received from beer and alcohol sales during the 1988 Orange Bowl Classic pursuant to its Agreement with Volume Services, Inc. (ii) The City of Miami shall decrease Volume Services, Inc. minimum guaranteed commitment (which is determined by Volume Services Inc.'s Agreement with the City) for the 1988 Orange Bowl Classic by the sum of $37,173.00. (iv) The Orange Bowl Committee agrees to pay $8,625.00 to Volume Services, Inc., and Volume Services, Inc. agrees to pay such sum to the Non -Profit Organizations who would have sold beer and alcoholic beverages during the 1988 Orange Bowl Classic but are precluded from doing so as a result of this Agreement. (v) The City and Volume Services, Inc. fully understand and agree that the execution of this Agreement shall not in any way affect (ether than as provided herein) the parties` rights and obligati•7ns as set forth in prior agreements between the City acid Volume Services, Inc. Resolution Ratifying, Confirming and Approving City Manager's Execution of Agreement prohibiting Orange Bowl Classic Beer Sales It ie respectfully tecommended that the City Commission adopt the attached resolution to ratify, confirm and approve the action of the City Manager in executing an agreement between the City of Miami, the Orange Bowl Committee and Volume Services, Inc., for the purpose of accommodating the Orange Bowl Committee's desire to prohibit beer sales at the 1988 Orange Bowl Classic. BACKGROUNDI In November, 1987 the Department of parks, Recreation and Public Pacilities responded to An inquiry from the Orange Bowl Committee requesting that beer sales be banned from the 1988 Orange Bowl Classic football game for the purpose of better crowd control. Since the five year Concession Agreement between the City of Miami and Volume Services, Inc., authorized Volume Services to sell beer at university football events, the Orange Bowl Committee was informed that Volume Services would have to be compensated for the astimated $29,670 lose Volume Services would incur if they could not sell beer. On December 22, 1987, an agreement between the City of Miami, the Orange Bowl Committee and Volume Services, Inc., for the purpose of prohibiting beer sales at the 1988 Orange Bowl Classic football game only was executed by the City Manager. In this agreement the City waived its beer revenues estimated at $37,173 and agreed to decrease volume Services' minimum annual guaranteed commitment by the same amount. The Orange Bowl Committee agreed to pay Volume Services $29,670 for not selling beer and to pay M 625 to those nonprofit service groups which would have sold beer at the game.
