A RESOLUTION SUPPORTING THE METROPOLITAN DADE
COUNTY MIAMI RIVER CANAL SANITARY SEWER
SPECIAL TAXING DISTRICT; REQUESTING DADE
COUNTY TO PROVIDE THE CITY WITH AN ESTIMATE
OF COST TO INCLUDE AN UNSEWERED AREA WITHIN
THE CITY OF MIAMI IN SAID DISTRICT; AND
AUTHORIZING THE CITY MANAGER TO NEGOTIATE AN
AGREEMENT, IN A FORM ACCEPTABLE TO THE CITY
ATTORNEY AND METROPOLITAN DADE COUNTY, TO
INCLUDE SAID UNSEWERED AREA WITHIN THE MIAMI
RIVER CANAL SANITARY SEWER SPECIAL TAXING
DISTRICT.
— WHEREAS, an
area within the
City of Miami
bounded by
N.W. 27
Avenue, the Miami
River and N.W.
20 Street is
in need of
sanitary
sewer service; and
WHEREAS, all other properties adjacent to the Miami River
within the City limits have been provided with sanitary sewers;
and
WHEREAS, it is the CityyIs goal to provide sanitary sewer
service to all areas of the City; and
WHEREAS, the Miami River is an important natural resource to
all of Dade County; and
WHEREAS, Metropolitan Dade County has established the Miami
River Canal Sanitary Sewer Special Taxing District; and
WHEREAS, it appears to be cost effective for the city to
include the aforementioned unsewered area within the Miami River
Canal Sanitary Sewer Special District.
a NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The City of Miami supports the efforts of
Metropolitan Dade County in establishing the Miami River Canal
Sanitary Sewer Special Taxing District.

Section 2. The City of Miami requests Metropolitan Dade
County to provide the City with an estimate of cost to include the
following described parcels of land within the Miami River Canal
Sanitary Sewer Special Taxing District:
Lots 1 through 16 of Riverdale Park as recorded in
Plat Book 21 at Page 19, and
Lots 7 and 8 of Tuttle Subdivision as recorded in
Plat Book B at Page 5.
Section 3. The City Manager is hereby authorized to
negotiate an agreement, in a form acceptable to the City Attorney
and Metropolitan Dade County, to include the aforesaid parcels of
land described in Section 2 of this Resolution, within the Miami
River Canal Sanitary Sewer Special Taxing District as established
by Metropolitan Dade County.

The following information and material should be considered by
you in your deliberations at today's Meeting:
Agenda item #21 (J-88-44) [Resolution authorizing
acquisition of property] The resolution language
authorizing the acquisition of land parcels from the
ezpansion of Roberto Clemente Park has been changed to
authorize the City Manager instead of the City Attorney
to acquire said parcels. Of course, our office will
assist the administration as necessary in regard to the
acquisition.
agenda item #23 (J-88-46) [Resolution supporting Dade
County Special Taming District and authorizing
ezeoution of an agreement to include an area located
within the City in said district] The authorization
for the City Manager to "ezeoute" an agreement with
Dade County has been changed to authorize the City
manager to "negotiate" an agreement with the County.
DOTS: At the time the Consent Agenda IS voted upon, if these
Items 021 and #23) are not removed from the Consent Agenda and
considered Separately, there should be an announcement made by
the Mayor that items #21 and #23 are being voted upon -as
modified' .
Agenda Ttem 452 (9-88-68) [Ordinance amending City
Code Section 38-40 by establishing "Boat Ramp Fees"]
The language referring to an assessment of the $4.00
boat ramp user fee has been modified from a "per launch
per day" basis to a "per launoh" basis.

Agenda item #64 (J-88-72) (Resolution calling for
Special municipal election) The resolution has been
modified to provide for the operation of a full-servioe
boatyard, marina, restaurant and marine -related retail
facility instead of being limited to the operation of a
full-servioe boatyard and marina. The additional
informative language appears in the title, the public
notice and the ballot question. The attached
resolution should be substituted for the item
previously distributed in the packet.
Agenda item *7a (J-88-83) (Resolution waiving section
of Code and authorizing ezeoution of agreement with
former City employee] The proposed professional
services agreement which is an attachment to this
resolution has been modified by adding a clause
requiring indemnification by the former employee, which
indemnification is required by the State of Florida in
its grant award of funds for the Program.

RECOMMENDATION:
It is respectfully recommended that the City Commission adopt the
attached resolution authorizing the City Manager to execute an
agreement with Metropolitan Dade County to include an unsewered
area of the City of Miami within the Metropolitan Dade County
River Canal Sanitary Sewer Special Taxing District.
BACKGROUND:
The Department of Public Works has reviewed a proposal by
Metropolitan Dade County to establish the Miami River Canal
Sanitary Sewer Special Taxing District. This district will serve
properties in unincorporated Dade County in the vicinity of the
Miami River between N.W. 27 Avenue and N.W. 42 Avenue.
A small unsewered area within the City limits bounded by the
Miami River, N.W. 20 Street and N.N. 27 Avenue borders the
County's proposed district. Based on estimates prepared by the
Department of Public Works, it should be more economical for the
City of Miami to serve these properties as part of the County's
sanitary sewer district rather than to serve them separately as a
small district administered by the City. The major difference in
cost can be attributed to the fact that an expensive sewer main
crossing of N.M. 27 Avenue at N.W. 20 Street would have to be
constructed under a separate City contract.
Pending a review and comparison of cost estimates for the
addition of this area to the County's sanitary sewer district, an
agreement must be entered into between the City and Metropolitan
Dade County for allocation of a fair equitable assessment charge
to the City and affected properties.
