HomeMy WebLinkAboutR-84-0481J-84-363 5/2/84 RESOLUTION NO. 4-481 A RESOLUTION ESTABLISHING 3:30 PM, THURSDAY, MAY 10, 1984, OR AT A RECONVENED MEETING, FOR A PUBLIC HEARING FOR CONSIDERATION OF A TWO YEAR TIME EXTENSION AND OTHER AMENDMENTS TO THE MIAMI CENTER II DUPONT PLAZA PROJECT DEVELOPMENT ORDER (RESOLUTIONS 81-840, SEPTEMBER 24, 1981; AND 82-71, JANUARY 28, 1982), AND CONSIDERATION OF WHETHER SUCH AMENDMENTS CONSTITUTE SUBSTANTIAL DEVIATIONS. WHEREAS, by Resolutions 81-840; September 24, 1981, and 82-71; January 28, 1982, the City Commission has approved a Development Order for the Miami Center II DuPont Plaza Project; and WHEREAS, by Resolution 83-1006; October 27, 1983, the recorded date of the Development Order was confirmed as May 12, 1982; and h-HERL;AS, the Commission is currently considering a proposed time extension to the Development Order.; and WHEREAS, the City Commission considers desires to give affected parties the opportunity to be heard on whether affir- mation of a time extension and consideration of other amendments constitute substantial deviations per Chapter 380 Florida Statutes; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. A public hearing will be held at 3:30 PM Thursday, May 10, 1984, or at a recovened meeting, at City Hall for consideration of a two year time extension and other amend- ments to the 14iami Center II DuPont Plaza Development Order (Resolutions 81-640, September 24, 1981, and 82-71, January 28, 1982), and consideration of whether such amendments constitute substantial deviations. Section 2. The City Clerk is to transmit immediately copies of this resolution to the State of Florida Department of Community Affairs and to the South Florida Regional Planning Council. Gary DATE: April 1,3, 1984 RILE: City Manager SUBJECT: Establishment of Public Hearing Date z Amendments to the Miami Center II FROM: - REFERENCES gio Rodriguez, Director DuPont Plaza Project Development Planning Department Order; Resolutions 81-840, ENCLOSURE/24/81; and 82-'71, 1/28/82 "i V ! 4 It is recommended that the Commission establish 3:30 PI.1 Thursday, June 28, 1984, as the public hearing date to consider affirming a time extension and other amendments to the Miami Center 11 DuPont Plaza Development Order(Re solutioils 81-8 0, September ^�2 1, `1 1-, and 82-71, January 28, 1982), and consideration of finding that these amendments do not constitute substantial deviations, per the attached resolution. The City Commission approved a Development Order for the Miami Center II DuPont Plaza Project by Resolutions 81-840, September 24, 1981; and 82-71, January 28, 1982. By Resolution 83-1006; October 27, 1983, the recorded date of the Development Order was confirmed as May 12, 1982. According to the Development Order, substantial construction was to commence within 2 years of the recorded date of the Development Order. While the developer has not proceeded to construction, the City derives substantial benefits in the Development Order. It is in the Lest interests of the City to establish a public hearing on June 28, 1984, to affirm a time extension (to be considered as companion item April 26), and any other amendments which may be brought forward by the developer. At the June 28th hearing, affected parties would have the opportunity to speak to any amendments; the Commission would then consider whether these amendments constituted substantial deviations.
