The requested approvals include uses such as theater (Assembly), office, retail (including food and beverage), and public parking, all to further the continued operation of a historic civic and cultural facility. To the extent that additional requests are needed in conjunction with the Exception, the County seeks to include those requests in its application. PROPERTY The Property is located in a Civil Institutional (CI) Transect Zone and is within the Coconut Grove Neighborhood Conservation District (NCD-3) overlay. The site fronts Main Highway and is located east of Via Abitare Way (alley), south of Thomas Avenue (alley), and north of Charles Avenue. The abutting parcels surrounding the site are zoned T3, T4, and T5 (see Figure 1). Page 1 of 7 Figure 1: Existing Miami 21 Transect Zoning Map The Future Land Use Map (FLUM) designation for the Property is Major Institutional, Public Facilities, Transportation and Utilities (see Figure 2). The intent is to accommodate federal, state, and local governmental activities, as well as major public or private health, recreational, cultural, religious, educational, transportation, and utility facilities. As proposed, the project is consistent with the goals, objectives, and policies of the City of Miami Comprehensive Neighborhood Plan Policy LU-1.3.15, which "encourage[s] a development pattern that enhances existing neighborhoods by developing a balanced mix of uses including areas for employment, shopping, housing, and recreation in close proximity to each other." Figure 2: Future Land Use Map Page 2 of 7 PROJECT BACKGROUND The County seeks to rehabilitate and restore the Coconut Grove Playhouse (Playhouse), an iconic historic building to its 1927 glory, to return great theater to the historic home of theater in Coconut Grove in a new approximately 300-seat theater that honors the past, and to create a hub for the community with its pedestrian -friendly spaces. A parking garage that includes office space, lining the building's frontage to Main Highway, is proposed for the north side of the site where surface parking currently exists. The Playhouse Garage building will serve the needs of the theater as well as nearby merchants and the Grove community. The ground floor of the historic Playhouse Gateway building will return to its original use as small retail spaces. Offices will occupy the upper levels of both the Playhouse Gateway building and the Playhouse Garage building. The ground floor of the Playhouse Garage building will include a food and beverage space to serve the theater's catering needs and support public gatherings. The plan proposes a pocket park adjacent to the educational space at the Northwest corner of the Playhouse Garage. The education space will provide access to artistic classes and community activities that engage the residential neighborhood to the west. A wide promenade adjacent to the parking garage structure will help create a campus -style ambiance and provide community connectivity through the site. The project has been intentionally designed to reduce impacts on adjacent residential areas with the relocation of the stage tower, the tallest portion of the project, further into the site from its original location, so that it is not easily seen from the residential neighborhood. The previously proposed office uses on the upper levels of the Playhouse Garage Building fronting the residential neighborhood have been relocated to front Main Highway. Architectural treatments and screens will be used to shield the view of vehicles in the garage from the sides and back of the structure. An educational space on the ground level will front the pocket park and will be used to engage the community through classes and cultural enrichment activities. PREVIOUS APPROVALS On November 7, 2018, the project received approval from the Planning Zoning and Appeals Board (PZAB) pursuant to Resolution PZAB-R-18-059 (Exhibit A). Following PZAB approval, the County promptly applied for the Certificate of Appropriateness (CoA) from the Historic and Environmental Preservation Board (HEPB) for the full project. After a series of appeals, the County obtained the CoA approval via City Resolution No. R-19-0169 (Exhibit B). More recently, the CoA has been tolled and extended pursuant to section 252.363 of the Florida Statutes (Exhibit C). Litigation related to the CoA stalled the permitting process until the appeals concluded on June 6, 2022. Because the PZAB approval was contingent on meeting all other applicable requirements pursuant to Chapter 23 of the City Code and the project could not move forward with the permitting process until the CoA litigation was resolved, the 2018 PZAB approval could not be acted upon before the date of expiration. The County requested by letter dated July 2022 that the 2018 PZAB approval be deemed equitably tolled due to the County's inability to act on the approval during the pendency of the CoA appeals, however, the County has no record of a written response. More recently, the County renewed its request for equitable tolling by letter dated September 18, 2025 (Exhibit D). On October 23, 2025 and October 31, 2025, the City provided e-mail correspondence (which is included herein as part of the project's entitlement history) indicating that "the City Attorney's Office's position has not changed since several years ago when this issue was initially brought up regarding the equitable tolling," however to date the City has not issued a formal written decision rejecting the County's request for tolling.' 1 In submitting this Exception and Waivers application, the County does not waive or forfeit the right to challenge the City's decision with respect to tolling of the 2018 PZAB approval and preserves all rights and arguments related thereto. Page 3 of 7 REQUEST Significant deterioration of the ornate facade walls of the historic Playhouse Gateway building has been identified. The County's plan includes the commitment to rebuild walls from the interior to minimize damage to the architectural ornamentation and fully restore the historic front facade, while replacing and rebuilding certain side and back walls and installing a new roof on the historic building. This commitment is evident in the revisions to the existing permit for the Phase I scope of work under permit number BD23000058001. In addition to the above, the restoration of the building's original design will include: • Restoring the building to its original sienna color based on the restoration team's detailed paint sampling and testing; • Having small neighborhood shops once again engage the street, as they originally did (this will not be a mall, which was never contemplated); • Preserving, protecting, and restoring the facade architectural ornamentation that has served as the southern gateway entrance into Coconut Grove for almost 100 years. The plan maintains the original diagonal axis of the theater, along which a new 300-seat theater will be positioned. A crescent shaped outdoor space, reminiscent of the original theater lobby's footprint, will create the transition between old and new and will serve as a community gathering space open to the public. The new theater will include front -of -house and back -of -house spaces and amenities that contemporary users and audiences expect and demand, from patron comfort features and exceptional sightlines to catwalks and state-of-the-art theater and acoustical systems and equipment. The exterior of the new theater is intentionally designed to be physically and architecturally distinct from the historic Playhouse Gateway Building and its cladding is inspired by the coral rock walls prevalent throughout the area and the lush vegetation canopy that is such a distinctive feature of Coconut Grove. Inside, remaining elements from the 1927 Kiehnel and Elliott movie house such as the Solomonic columns, concrete grilles, fish fountains, cornice, and the proscenium arch will be displayed and/or integrated into the new theater. Interpretative electronic materials will be used throughout the project to celebrate the significant history of the site. Accordingly, based on close consultation with City staff, the previously requested and approved Exception and Waivers are hereby being re -submitted for approval. The requested Exceptions and Waivers are not sought for development convenience or increased intensity, but rather to allow the functional restoration of a civic cultural facility within the Civil Institutional (CI) Transect Zone, consistent with the intent of Miami 21, the Coconut Grove Neighborhood Conservation District (NCD-3), and the City of Miami Comprehensive Neighborhood Plan. EXCEPTIONS 1. Exception pursuant to Article 5, Section 5.7.2.4(a), and Article 7, Section 7.1.2.6 of the Miami 21 Code, to allow the restoration, and rehabilitation of a designated historic property located within a Civic Institution (CI) Transect zone. The requested exception enables restoration of a civic landmark in a manner that maintains architectural integrity and cultural legacy while supporting Miami 21's Intent set forth in Article 2.1.2. Approval allows the project to maintain the Playhouse's historic integrity and public function while delivering a context -sensitive restoration that minimizes neighborhood impacts. Strict application of CI zoning limitations without allowance for historic restoration would be inconsistent with the Code's stated intent to protect and enhance Miami's historic and cultural resources. 2. Exception pursuant to Article 4, Table 3 of the Miami 21 Code, to allow commercial uses accessory to and in support of a civic and cultural facility within the CI zoning district. Page 4 of 7 The requested exception advances the purpose and intent of Article 2.1 by supporting economically sustainable civic and cultural facilities and encouraging functional, active urban environments. The limited commercial components support operational sustainability and consistent day-to-day activation of the site in a manner aligned with Miami 21's development goals rather than creating a single -purpose facility disconnected from the surrounding urban context. 3. Exception pursuant to Article 4, Table 3 of the Miami 21 Code, to allow office uses, supporting the operation, administration, programming and financial viability of the theater, as well as other professional and administrative uses. The requested exception is consistent with the Community guiding principles set forth in Article 2.1.3.2, which promote development that supports civic, cultural, and economic activities without introducing adverse impacts on surrounding areas. Office uses reinforce the project's role as an active, programmatically diverse, and sustainable anchor within the community. 4. Exception pursuant to Article 4, Table 3 of the Miami 21 Code, to allow public parking as an accessory and incidental use in support of a historic civic and cultural facility. The requested exception is consistent with the Block and Building guiding principles set forth in Article 2.1.3.3, which emphasize coordinated use of land, efficient infrastructure, and functional development patterns. The proposed garage replaces existing surface parking with structured parking that is architecturally screened and designed to reduce visual and operational impacts, while its Main Highway frontage is lined with active uses and office space to maintain an urban streetscape and encourages principles of Crime Prevention Through Environmental Design (CPTED). The public parking is an accessory and incidental use that directly enables public access to a civic cultural destination, supports safe and efficient event operations, and advances efficient shared parking management in Coconut Grove. WAIVERS The following Waivers are pursuant to Article 5, Section 5.7.2.4(d) of Ordinance No. 13114. o To allow an increase in the maximum lot coverage from 50% to 64%; o To allow a reduction of the minimum green space from 30% to 14.8%; o To allow an increase in the maximum driveway width from ten (10) feet to thirty (30) feet; and o To allow an increase in the maximum impervious pavement within the front setbacks along Main Highway and Charles Avenue from 30% to 100%. Each Waiver is consistent with the intent of the Civil Institutional (CI) Transect Zone, the Coconut Grove Neighborhood Conservation District (NCD-3), and the guiding principles of the Miami 21 Code, and is necessitated by site -specific conditions, historic preservation requirements, and the operational needs of a major civic and cultural facility. The Waivers requested herein are the minimum relief necessary to allow the functional realization of the approved program while maintaining compatibility with surrounding neighborhoods and advancing Miami 21's objectives for context -sensitive urban development. Page 5 of 7 1. Waiver pursuant to Article 5, Section 5.7.2.4 (d) of Ordinance 13114, to allow an increase in the maximum lot coverage from 50% to 64%; The footprint of the historic Playhouse Gateway building is fixed and must be preserved, and the dimensional requirements of contemporary theater design cannot be meaningfully reduced without compromising functionality. Rather than increasing height or mass adjacent to residential neighborhoods, the proposed design strategically distributes building coverage across the site to reduce perceived bulk, relocate the tallest elements away from sensitive edges, and preserve key historic spatial relationships, including the original diagonal axis and crescent -shaped gathering space. The increased lot coverage therefore enables a lower -impact, context - responsive massing approach that is more consistent with the intent of Miami 21 and the NCD- 3 overlay than strict adherence to the base standard. 2. Waiver pursuant to Article 5, Section 5.7.2.4 (d) of Ordinance 13114, to allow a reduction of the minimum required green space from 30% to 14.8%; The existing site has historically been characterized by a theater structure surrounded by extensive surface parking, with minimal landscaping that primarily served as perimeter buffering rather than functional civic open space. The proposed project transforms this condition by replacing large impervious areas with consolidated, functional, and publicly accessible open spaces designed to support a civic and cultural environment. Key improvements include a pocket park adjacent to public parking, landscaped buffers along sensitive site edges, and a wide internal promenade that enhances pedestrian connectivity throughout the site. This approach aligns with the intent of Article 2.1 of Miami 21 by reinforcing terminated vistas and view corridors, while providing context -appropriate open and green spaces that uphold the Code's objectives and respond to the site's unique constraints and programmatic requirements. 3. Waiver pursuant to Article 5, Section 5.7.2.4 (d) of Ordinance 13114, to allow an increase in the maximum driveway width from ten (10) feet to thirty (30) feet; and The proposed driveway width is necessary to safely and efficiently accommodate the circulation demands of a major cultural facility that serves theater patrons during peak event conditions, office users, service and loading functions, and emergency access requirements. The site is constrained by multiple frontages and significant pedestrian activity, and a narrower driveway would result in operational conflicts, queuing issues, and potential safety concerns. 4. Waiver pursuant to Article 5, Section 5.7.2.4 (d) of Ordinance 13114, to allow an increase in the maximum impervious pavement within the front setbacks along Main Highway and Charles Avenue from 30% to 100%. The frontages along Main Highway and Charles Avenue function as active, pedestrian -oriented urban corridors serving a high -activity civic and cultural destination. The proposed impervious areas are designed as widened sidewalks, pedestrian gathering areas, and accessible circulation spaces that support theater operations, public events, and daily community use. In this context, impervious frontage enhances pedestrian safety, accessibility, and functionality and is consistent with the urban character of the surrounding streets. Landscape treatment is provided through street trees, shaded pedestrian zones, and adjacent landscaped areas, ensuring that the waiver does not diminish the streetscape or neighborhood character. The requested relief therefore Page 6 of 7 advances Miami 21's goals for vibrant, walkable public spaces while accommodating the operational realities of a major cultural institution. The requested Exceptions and Waivers represent the minimum relief necessary to allow the functional restoration and operation of a designated historic civic and cultural facility, are consistent with the intent of the Miami 21 Code, and will not be injurious to surrounding properties or the public realm. We appreciate the time and input you and your staff have given us in preparing this application, and we believe the project, as designed, addresses the comments City staff have expressed in our discussions. We respectfully request that the enclosed application be scheduled for any necessary hearings before the appropriate City agencies and boards, such as the PZAB, so that we may be able to continue to move through the approval process. We look forward to continuing to work with you and your staff to make this long-awaited project a reality. Sincerely, 7J-141A- 14t7 Ashlee K. Comment No. 8: Please provide a brief narrative on the inclusion of new plants on the plant palette sheet. Likewise, please provide a brief narrative on the proposal to remove & replace trees along Main Highway and Charles Avenue which were previously proposed to be maintained (refer to Sheet L1-101.1 and Sheet L1-101.2). Response: SHEET LO-002.1 — PLANTING PALETTE The inclusion of new plant material responds to a meeting held with the City of Miami on October 10, 2025, during which additional screening of the garage was recommended. In response, taller plant material and vines have been introduced to enhance visual screening. Additionally, due to limited availability of certain species, some smaller trees were removed from the palette and replaced with more commonly available native species that meet the City's standards. SHEET L1-101.1 —TREE DISPOSITION In the previously approved set, one Banyan along Charles Avenue and three Mahogany trees along Main Highwaywere proposed for relocation. Following discussions held during the demolition phase with the City of Miami and the project arborist, Jeff Shimonski, it was determined that these trees are not suitable candidates for relocation. The Banyan was removed under the approved demolition permit. The updated design reinforces this intent through the use of a suspended pavement system, which provides adequate soil volume, supports healthier root development, and promotes a more sustainable long-term street tree canopy.
