Purpose of Item:
The nature of this item is to respectfully request a resolution of the Miami City
Commission with attachments, by a four -fifths (4/5) affirmative vote, ratifying, confirming
and approving the City Manager's emergency finding, that is it most advantageous for
the City of Miami to waive the competitive sealed bidding procedure pursuant to Section
18-90 of the Code of the City of Miami, Florida as amended ("City Code") and
retroactively approving the selection of Waste Management Inc. of Florida ("Waste
Management") as the designated recycling facility to receive the program recycling
materials at an approximate cost of $143.99 per ton (estimated at 8,000 tons annually);
Subject to the availability of funds and budget approval at the time of need; Further
authorizing the City Manager to negotiate and execute any and all documents, including

prior budgetary approvals, compliance with all applicable provisions of the Code of the
City of Miami, Florida, as amended, ("City Code"), including the City's Procurement

Background of Item:
The Department of Solid Waste requires immediate services for the disposal of
residential recycling materials following the abrupt termination of service by the previous
contractor, who has withdrawn from the local recycling market and is no longer
accepting recycling loads. This unforeseen interruption created an urgent operational
gap, necessitating prompt action to maintain uninterrupted recycling services for
residents. Without securing immediate disposal services, the City would have faced a
significant buildup of recyclable materials, creating immediate environmental,
operational, and public health concerns. Waste Management has the capacity and
readiness to receive and process the collected recycling materials. Accordingly, the City
has entered into an eighteen (18) month Service Agreement with Waste Management,
with the option to renew for an additional six (6) month period upon mutual agreement.
During this time, the City will assess market conditions to determine the best long-term
strategy moving forward.
