A RESOLUTION AUTHORIZING AND DIRECTING THE CITY
ATTORNEY TO RETAIN HOWARD HADLEY,.ESQ. OF THE LAW
FIRM OF SCOLFIELD, GILMAN, COOPER, NICHOLS, TATICH
AND ADAMS, WINTER PARK, FLORIDA, TO REPRESENT THE
CITY OF MIAMI IN ALL ITS CONDEMNATION PROCEEDINGS
FOR A RETAINER OF $5,000 AND 2% OF THE TOTAL
CONDEMNATION AWARD AGAINST WHICH 2% SHALL BE COUNTED
THE $5,000, AND THE PAYMENT OF SUCH ATTORNEY'S
SERVICES TO COME OUT OF THE PROCEEDINGS OF THE BOND
ISSUE.
WHEREAS, the City Commission of the City of Miami has
previously instructed the City Attorney pursuant to the direction
of Resolution No. 72-23 to negotiate for an attorney expert in
condemnation and eminent domain matters; and
WHEREAS, the City Attorney has recommended that the
expert to be hired is Howard Hadley, Esq. of the law firm of Scolfield,
Gilman, Cooper, Nichols, Tatich and Adams, 501 Park Avenue South,
P. O. Drawer 1510, Winter Park, Florida 32789, who was formerly the
attorney for the State of Florida for condemnation proceedings, and
who is presently in private practice representing the State Road
Department in condemnation proceedings;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The City Attorney is hereby authorized and
directed to retain Howard Hadley, Esq. of the Law Firm of Scolfield,
Gilman, Cooper, Nichols, Tatich and Adams, Winter Park, Florida, to
and eminent domain
represent the City of Miami in all its condemnation/proceedings for
a retainer of $5,000 and 2% of the total condemnation award against
which 2% shall be counted the $5,000, and the payment of such
attorney's services to come out of the proceeds of the bond issue.
