HomeMy WebLinkAboutR-72-0208HY: er 5/10/72 '2 VAY i 1 lit ;;, �+ • 26 RESOLUTION NO.7&411111 20041# A RESOLUTION ADOPTING A POLICY STATEMENT REQUIRED BY THE DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT IN THE ACQUISITION OF LAND IN CONNECTION WITH THE CITY OF MIAMI'S APPLICATION FOR FEDERAL ASSISTANCE FOR THE CONSTRUCTION OF THE LIBERTY SANITARY SEWER IMPROVEMENT SR-5262. , passed /? and adopted by the Commission of The City of Miami on May.$7, 1972, the City Manager is authorized to make application to the Department of Housing and Urban Development, United States of America, for a grant under Public Law 89-117 for LIBERTY SANITARY SEWER IMPROVEMENT SR-5262; and WHEREAS, in order to comply with Section 402 of the Housing and Urban Development Act of 1965, the City of Miami must submit a land acquisition policy statement. NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The following policy statement, required by the Department of Housing and Urban Development in the acquisi- tion of land in connection with the City of Miami's application for Federal assistance for the construction of the LIBERTY SANITARY SEWER IMPROVEMENT SR-5262 be, and the same is hereby adopted: WHEREAS, pursuant to Resolution No. 72 -AD 7 "DOLL' E:1'j INDEX ITEM NO. ift 1 CITY COPE v:77.,.,. Of MAY i 91972 �- RESOWTlflN hlp. f' The City of Miami land acquisition policy in acquiring any real property, if it should become necessary, has always been to make every reason- able effort to acquire the subject property by negotiated purchase before instituting eminent domain proceedings against the property. The City will not require any owner to surrender the right of possession of his property until the City pays or causes to be paid to the owner(s) the agreed purchase price arrived at by negotiation, or in any case where the amount of the payment to the owner(s) is in dispute, not less than 75 percent of the proposed fair value as approved by the City of Miami and agreed on by the Department of Housing and Urban Development. The City of Miami shall not require any person lawfully occupying property to surrender possession without at least 90 days written notice from the City of the date on which possession will be required.
