A RESOLUTION GRANTING A VARIANCE FROM
ORDINANCE NO. 6871, ARTICLE VI, SECTIONS
2 (1) AND 3 (2) (a) , TO PERMIT CONSTRUCTION
OF DUPLEX ON LOT 9 LESS EAST 5', BLOCK 4,
ALTA VISTA CORR (6-4), LOCATED AT APPROXI-
MATELY 2 N.E. 51ST STREET, WITH WIDTH OF
39.68' (40' MINIMUM REQUIRED), WITH MIAMI
AVENUE SETBACK OF 9.6' (15' REQUIRED),
LOCATED IN AN R-2 (TWO-FAMILY) DISTRICT.
WHEREAS, the Planning and Zoning Board of the City of
Miami, at its meeting held on April 10, 1972, passed and
adopted by a 9 to 0 vote its Resolution No. 72-85, recommend-
ing granting a variance from Ordinance No. 6871, Article VI,
Sections 2 (1) and 3 (2) (a) , as hereinafter set forth; and
this Commission deems it advisable in the interest of the
general welfare of the City of Miami to grant this variance
requested on the ground that a refusal would result in practi-
cal difficulties and unnecessary hardship to the applicant
under an R-2 (Two -Family) District;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF
THE CITY OF MIAMI, FLORIDA:
Section 1. That the application for a variance from
Ordinance No. 6871, Article VI, Sections 2 (1) and 3 (2)(a),
to permit construction of duplex on Lot 9 less East 5',
Block 4, ALTA VISTA CORR, Plat Book 6, Page 4, with width
of 39.68' (40' minimum required), with Miami Avenue setback
of 9.6' (15' required), located at approximately 2 N. E. 51st
Street, in an R-2 (Two -Family) District, be and the same is
hereby granted.

REMARK:

Section 2. This variance shall become null and void
unless the use is commenced within six months of the effect-
ive date of this Resolution. Extension may be granted by the
City Manager pursuant to the provisions of Article XXXI,
Section 4, of Ordinance No. 6871.

The Miami Planning Board, at its meeting of April 10, 1972, Item
#6, following an advertised Hearing, adopted Resolution No. 72-85
by a 9 to 0 vote recommending Variance from Ordinance No. 6871,
ARTICLE VI, Sections 2' (i) and 3 (2) (a) , to permit construction
of Duplex on Lot 9 less E 5', Block 4, ALTA VISTA CORR (6-4),
located at approximately 2 N. E. 51st Street, with lot width of
39.68' (40' minimum required), with Miami Avenue setback of 9.6'
(15' required); zoned R-2 (Two -Family).
Three objections were received in the mail.
A RESOLUTION to provide for this Variance has been prepared by the
City Attorney's office and submitted for consideration of the City
Commission.
