RESOLUTION NO 7 — 9:6"
A RESOLUTION ACCEPTING THE PLAT ENTITLED
TORRIMAR SUBDIVISION, A SUBDIVISION IN
THE CITY OF MIAMI, FLORIDA, LOCATED ON
THE SOUTH SIDE OF N.E. 61ST STREET BETWEEN
5TH AVENUE AND BISCAYNE BOULEVARD, AND
ACCEPTING THE DEDICATIONS SHOWN ON SAID
PLAT, AND ACCEPTING A COVENANT TO RUN WITH
THE LAND POSTPONING THE IMMEDIATE CONSTRUC-
TION OF PAVEMENT, CURB AND GUTTER AND ONE
DRAINAGE STRUCTURE, AND AUTHORIZING AND
DIRECTING THE CITY MANAGER AND CITY CLERK
TO EXECUTE THE PLAT.
WHEREAS, the City Planning and Zoning Board and the
Department of Public Works have recommended the acceptance
of the plat; and
WHEREAS, it was recommended that the developers of
TORRIMAR SUBDIVISION execute a Covenant to Run With the Land
postponing the immediate construction of pavement, curb and
gutter and one storm drainage structure;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF
THE CITY OF MIAMI, FLORIDA:
Section 1. The Plat entitled TORRIMAR SUBDIVISION,
being a replat of portions of WHITE'S SUBDIVISION OF LEMON
CITY (B-32), lying in the S.E. 1/4 of Section 18, Township
53 South, Range 42 East, City of Miami, Dade County, Florida,
which by reference is made a part hereof as if fully incor-
porated herein and the dedications as shown thereon together
with all existing and future plantings, trees and shrubbery
on said property, to the perpetual use of the public be and
the same are hereby accepted and confirmed by the City of
Miami, Florida.

Section 2. Except for the construction of those
improvements provided for in the Agreement entered into
between the Owner and the Director of the Department of Public
Works on behalf of the City of Miami, Florida, dated April 26,
1971, the requirements of Chapter 54, Section 54-20, Code of
the City of Miami, Florida, and State law as to improvements
to be made in subdivisions will hereby expressly be waived.
Section 3. The Covenant to Run With the Land executed
by Coral C. Torres, Unremarried Widow of Heriberto Torres Solar
Deceased, and Maria T. Sanchez, postponing the immediate con-
struction of full width asphalt pavement consisting of eight
(8") inch limerock base with one (1") inch thick asphaltic
concrete surface course, concrete curb and gutter and one
drainage structure until such time as required by the Department
of Public Works of the City of Miami, Florida, be accepted and
recorded after the plat has been recorded in the Public Records
of Dade County, Florida.
Section 4. Of all other requirements of State law
concerning the posting of a Performance Bond for the con-
struction of improvements, that portion pertaining to the
maintenance of said improvements is hereby expressly waived.
Section 5. The requirements of State law concerning
the showing of grades of rights -of -way on the Plat are hereby
expressly waived.
Section 6. The City Manager and the City Clerk, both
of the City of Miami, Florida, are hereby authorized and
directed to execute the Plat.
