A RESOLUTION GRANTING A VARIANCE FROM
ORDINANCE NO. 6871, ARTICLE XVI, SECTIONS
4 (1) (c) (s) , AND ARTICLE XXIII, SECTIONS
2 (2) AND 3 (32), TO PERMIT CONSTRUCTION
OF TWO-STORY ADDITION TO STRUCTURE LOCATED
ON S 50' OF LOTS 1 AND 2, AND N 45' OF LOTS
19 AND 20, BLOCK 39 N, MIAMI (B-41), WITH
0' FRONT SETBACK (5' REQUIRED), WAIVING 5
OF 14 REQUIRED OFF-STREET PARKING SPACES,
SPACES TO BE 9' X 20' (10' X 20' REQUIRED),
LOCATED AT 820 N. E. 2ND AVENUE, IN A C-4
(GENERAL COMMERCIAL) DISTRICT.
WHEREAS, the Planning and Zoning Board of the City of
Miami, at its meeting held on March 6, 1972, passed and
adopted by a 6 to 2 vote its Resolution No. 72-56, recommend-
ing denial of variance from Ordinance No. 6871, Article XVI,
Sections 4 (1)(c)(s), and Article XXIII, Sections 2 (2) and
3 (32), as hereinafter set forth; and this Commission deems
it advisable in the interest of the general welfare of the City
of Miami to grant this variance requested on the ground that
a refusal would result in practical difficulties and unnecessary
hardship to the applicant under a C-4 (General Commercial)
District;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF
THE CITY OF MIAMI, FLORIDA:
Section 1. That the application for a variance from
Ordinance No. 6871, Article XVI, Sections 4 (1)(c)(s), and
Article XXIII, Sections 2 (2) and 3 (32), to permit construction
of two-story addition to existing structure, located on S 50'
of Lots 1 and 2, and N 45' of Lots 19 and 20, Block 39 N,

MIAMI, Plat Book B, Page 41, with 0' front setback (5'
required), waiving 5 of 14 required off-street parking
spaces, spaces to be 9' x 20' (10' x 20' required), located
at 820 N. E. 2nd Avenue, in a C-4 (General Commercial)
District, be and the same is hereby granted.
Section 2. This variance shall become null and void
unless the use is commenced within six months of the effective
date of this Resolution. Extension may be granted by the City
Manager pursuant to the provisions of Article XQOXI, Section 4,
of Ordinance No. 6871.

The Miami Planning Board, at its meeting of March 6, 1972, Item
#3, following an advertised Hearing, adopted Resolution No. 72-56
by a 6 to 2 vote (one member absent) recommending DENIAL for
Variance from Ordinance No. 6871, ARTICLE XVI, Sections 4 (1) (c)
(2), and, ARTICLE XXIII, Sections 2 (2) and 3 (32), to permit
construction of 2-story addition to existing structure on S 50'
of Lots 1 and 2 and N 45' of Lots 19 and 20, Block 39N, MIAMI (B-41),
located at 820 N. E. 2nd Avenue, with 0' front setback (5' required),
waiving 5 of 14 required off-street parking spaces, spaces to be
9' X 20' (10' X 20' required); zoned C-4 (General Commercial).
No objections were received in the mail.
A RESOLUTION to provide for this Variance has been prepared by
the City Attorney's office and submitted for consideration of
the City Commission.
