RESOLUTION NO. 70147
A RESOLUTION GRANTING A VARIANCE FROM
ORDINANCE NO. 6871, ARTICLE XI, SECTION 6,
TO PERMIT CONSTRUCTION OF 3-STORY OFFICE
BU);LDING OVER PARKING, ON LOTS 1, 2 AND 3,
BLOCK 24, BAY SHORE UNIT NO. 3 (12-50),
WITH 28% LOT COVERAGE (26% PERMITTED),
SUBJECT TO 5 FOOT DEDICATION ALONG BISCAYNE
BOULEVARD, LOCATED AT 5555 BISCAYNE BOULE-
VARD, IN AN R-C (RESIDENCE -OFFICE) DISTRICT.
WHEREAS, the Planning and Zoning Board of the City of
Miami, at its meeting held on March 20, 1972, passed and
adopted by a 5 to 3 vote its Resolution No. 72-68, recom-
mending granting a Variance from Ordinance No. 6871, Article
XI, Section 6, as hereinafter set forth; and this Commission
deems it advisable in the interest of the general welfare of
the City of Miami to grant this variance requested on the
ground that a refusal would result in practical difficulties
and unnecessary hardship to the applicant under an R-C
(Residence -Office) District;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. That the application for a variance from
Ordinance No. 6871, Article XI, Section 6, to permit con-
struction of 3-story office building over parking, on Lots 1,
2 and 3, Block 24, BAY SHORE UNIT NO. 3, Plat Book 12, Page 50,
., with 28% lot coverage (26% permitted), subject to 5 foot dedi-
cation along Biscayne Boulevard, located at 5555 Biscayne
Boulevard, in an R-C (Residence -Office) District, be and the
same is hereby granted.

REMARKS:
Section 2. This variance shall become null and void
unless the use is commenced within six months of the effective
date of this Resolution. Extension may be granted by the
City Manager pursuant to the provisions of Article XXXI,
Section 4, of Ordinance No. 6871.

The Miami Planning Boards_ at its meeting.of_March 20,..1972, Item
#7, following an advertised Hearing, adopted Resolution No. 72-68
by a 5 to 3 vote (one member abstained), recommending Variance
from Ordinance No. 6871, ARTICLE XI, Section 6, to permit construc-
tion of 3-story office building over parking, with 28% Lot Coverage
(26% permitted) on Lots 1, 2, and 3, Block 24, BAY SHORE UNIT NO. 3
(12-50), subject to a 5 foot dedication along Biscayne Boulevard,
zoned R-C (Residence -Office).
Eight objections were received in the mail.
A RESOLUTION to provide for this Variance has been prepared by
the City Attorney's office and submitted for consideration of
the City Commission.
