A RESOLUTION RESCINDING RESOLUTION NO.
41541 ADOPTED MAY 13, 1970 ENTITLED "A
RESOLUTION AWARDING THE BID RECEIVED
MAY 12, 1970 OF LAYNE DREDGING CO. IN
THE ESTIMATED AMOUNT OF $97,920.00 FOR
THE DINNER KEY - EAST MOORING AREAS -
1970; ALLOCATING THE AMOUNT OF $109,670.00
FROM THE ACCOUNT ENTITLED "DINNER KEY
MARINA BOND FUND"; AND AUTHORIZING THE
CITY MANAGER TO EXECUTE A CONTRACT THERE-
FOR." DIRECTING THE BALANCE OF FUNDS
REMAINING IN THE ALLOCATION FOR THIS PRO-
JECT TO BE RETURNED TO THE ORIGINAL ACCOUNT
"DINNER KEY MARINA BOND FUND"; AND DIRECT-
ING THE PROPER OFFICIALS OF THE CITY OF
MIAMI TO CANCEL CITY OF MIAMI PURCHASE
ORDER NO. 04562 DATED MAY 25, 1970 AND
ISSUED TO LAYNE DREDGING CO.
WHEREAS, the City Commission directed the City Manager
to proceed with the development of a small boat mooring area
in Biscayne Bay, said area lying northeast of the Miami City
Hall, and said project was designed and developed under the
project named "Dinner Key - East Mooring Areas - 1970, Job
No. 2520"; and
WHEREAS, Resolution No. 41541, adopted May 13, 1970,
awarded a contract to Layne Dredging Co. for dredging the
area and forming protective moles and, pursuant to said
resolution, the City of Miami issued Purchase Order No. 04562
to Layne Dredging Co. under date of May 25, 1970; and
WHEREAS, newly established pollution control standards
were instituted requiring protective dykes or aprons around
the proposed dredging to control turbidity from such opera-
tions, which requirement had not been contemplated nor

included in the contract specifications for the afore-
said project; and
WHEREAS, it now appearing that the City will be
unable to proceed with this project, it is necessary to
rescind the resolution authorizing execution of the con-
tract and to cancel Purchase Order No. 04562 dated May 25,
1970, calling for the construction of said project and,
furthermore, to return to the proper account the unexpended
balance of funds allocated for this project.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE •
CITY OF MIAMI, FLORIDA:
Section 1. Resolution No. 41541, adopted May 13, 1970,
entitled "Dinner Key - East Mooring Areas - 1970" be, and the
same is hereby rescinded.
Section 2. The proper officials of the City of Miami be,
and they are hereby, directed to cancel City of Miami Purchase
Order No. 04562, dated May 25, 1970, and issued to Layne
Dredging Co.
Section 3. The unexpended balance of funds remaining in
the allocation for the aforesaid project be, and the same are
hereby, returned to the original account entitled "Dinner Key
Marina Bond Fund".
