WHEREAS, said System and Plan now both exist in accordance
with the
codified form as appears in Chapter 2 of the Code of the City
of Miami, Florida, 1957, as amended, in addition to basic ordinance
form; and
WHEREAS, any addition or amendments to either said System

Florida, 1957, as amended;

Pa. agrapli (2) of Subsection 91 of Chapter 2
of the Code of the City of Miami, Florida, 1957,
as amended, .is hereby attended by adding the
following:
'tin addition, upon reaching minZimum,
service retirement age and 'upon such
retirement if a member has served in
the capacity of City Manager, as provided
in Article 15 of the City Charter, or as
City Attorney, as provided in Article 21
of the City Charter, and who has served
in such capacity for a period of not less
than ten (10) years since last becoming a
member, he shall also receive a. pension
equal to an additional ten percent (10%)
of average final compensation, provided
however, that such member' is not other-
wise eligible for such ten percent (10%)
of average final compensation as set forth
under the requirements and provisions of
Ordinance No. 8044 passed March 16,: 1972.
Paragraph (2) of Subsection 109 of Chapter 2 of the
Code of the City of Miami, Florida, 1957, as amended,
is hereby amended by adding the following;

Section n 2. If any section, sentence, clause, phrase or word
of this Ordinance is for any reason held or declared to, be ino unconstitu-
erative or void, such holding or invalidity shall not affect

the remaining portions of this Ordinance, and it shall be construed to
have been the intent of the Commission of the City of Miatni to pass
this ordinance without such unconstitutional, invalid or inoperative
part therein; and the remainder of this Ordinance after the exclusion
of such part or parts shall be deemed and held to be valid as if such
parts had not been included therein.
Section 3. That the requirement of reading this ordinance
on two separate days is hereby dispensed with by a vote of not less
than four -friths of the members of the Commission. 16bh
