LUTS P'OR THE PURPOSES OP LIVING OR SLEEPING THEREIN; PROVIDING A PENALTY REPEAL - /NO ALL LAWS IN OONPLtCT HEREWITH; AND PROVID- ING POEM A SEVERABILITY CLAUSE HEREIN; DECLARING THIS ORDINANCE TO BE AN EMERGENCY MEASURE AND DISPENSING WITH THE REQUIREMENT OF' READING THE,. SAME' ON TWO SEPARATE DAYS., BY A VOTE OP NOT, LESS THAN POUR -FIFTHS OP THE MEMRE1S ,OP THE COMMISSION BE IT ORDAINED BY THE COMMISSION OP THE CITY OP MIAMI, PLORIY)A Section 1. That the Miami City Code, Section 38, entitled "Offenses —Miscellaneous", is hereby amended by a new Section 38-54.1, entitled "Vehicles --Living or Sleeping Therein", to read as follows; Section 38-54.1 Vehicles --Living or Sleeping Therein. It Shall be unlawful for any person within the City to park any vehicle on public rights -of - way, public properties, or private parking lots, for the purposes of: (a) Living; or Sleeping; or Cooking; or (d) Bathing; or (e) Housekeeping. Section 2. Any person violating the provisions of Section 1 of this Ordinance shall befined and im- prisoned, or both fined and imprisoned, in accordance with Sections 3(aa) and 59(b) of the Charter of the City of Miami (Chapter 10847, Acts of Florida,, 1925, as amended) and Section 1-6 of the Code of the City, of Miam,Florida. Section 3. All ordinances, code seeti ns or parts thereof in conflict herewith, insofar AO they are in conflict, flirt, are hereby repealed. Section 4, it is declared to be the legislative intent of this body that if any seetian, subsection, hentenee, phrase or provision of this breihs.ryce is held invalid, the remainder of the Ordinance shill not be affected. Section 5. That this ordinance is hereby declared to be an emergency measure on the ground of urgent public need for the preservation of peace, health, safety and property in the City of Miami Section 6. That the requirement of reading this Ordinance on two separate days is hereby dispensed with by a vote of not less than four -fifths of the members of the Commission.
