HomeMy WebLinkAboutR-43348={ • HY:er 3/1/72 RESOLUTION NO47 C iV<J A RESOLUTION AUTHORIZING AND DIRECTING THE CITY ATTORNEY OF THE CITY OF MIAMI TO PROCEED WITH APPROPRIATE COURT ACTION TO ENFORCE THE CLAIM OF THE CITY OF MIAMI AGAINST THOSE PARTIES HE DEEMS RESPONSIBLE. WHEREAS, on February 14, 1968, a contractor, Genola Incorporated of Florida, entered into a Construction Contract with Unity Hall, Inc. to construct certain off -site improve- ments and in conjunction therewith, Genola Incorporated of Florida, as principal and The Hanover Insurance Company, as surety, executed an off -site bond to Unity Hall, Inc.; and WHEREAS, on February 15, 1968, Unity Hall, Inc. entered into a contract with the City of Miami for construc- tion of certain off -site improvements (the same as listed in the construction contract and off -site bond referred to above) and tendered the off -site bond to the City of Miami as a per- formance bond; and WHEREAS, the following off -site improvements have not been completed as of December 31, 1970: Landscaping / Relocation of water mains and appurtenances (125-feet) Asphaltic Concrete Pavement (approximately 1,580 square yards) Removal of existing sidewalk (approximately 600 square feet) Sidewalk (approximately 10,650 square feet) Curb and gutter (approximately 750 lineal feet) One storm drainage structure CITY CO}.4MJS,ION VECf, MAR '1 €1372 RESOLUTJON no. «33it2 REMARKS: Replace damaged curb and gutter (approximately 10 lineal feet) Replace six damaged sidewalk flags (165 square feet); and WHEREAS, the City Attorney has advised that it is in the best interest of the City of Miami to proceed with appropriate court action to enforce the claim of the City of Miami against those parties responsible. NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The City Attorney of the City of Miami is hereby authorized and directed to proceed with appropriate court action to enforce the claim of the City of Miami against those parties he deems responsible.
