A RESOLUTION GRANTING A VARIANCE FROM
ORDINANCE NO. 6871, ARTICLE IV, SECTION
21 (1)(b), TO PERMIT CONSTRUCTION OF RADIO
TRANSMITTING TOWER 407.75' HIGH (375' PER-
MITTED), TO BE ON TOP OF STRUCTURE LOCATED
ON LOTS 1, 2 AND 3, SMITH SUB (3-5), BEING
100 BISCAYNE BOULEVARD, LOCATED IN AN C-3
(CENTRAL COMMERCIAL) DISTRICT.
WHEREAS, the Planning and Zoning Board of the City
of Miami, at its meeting held on February 28, 1972, passed
and adopted by an 8 to 0 vote its Resolution No. 72-44,
recommending granting a Variance from Ordinance No. 6871,
Article IV, Section 21 (1)(b), as hereinafter set forth;
and this Commission deems it advisable in the interest of
the general welfare of the City of Miami to grant this
variance requested on the ground that a refusal would result
in practical difficulties and unnecessary hardship to the
applicant under a C-3 (Central Commercial) District;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF
THE CITY OF MIAMI, FLORIDA:
Section 1. That the application for a variance from
Ordinance No. 6871, Article IV, Section 21 (1)(b), to permit
construction of radio transmitting tower 407.75' high (375'
permitted), to be on top of structure located on Lots 1, 2
and 3, SMITH SUB, Plat Book 3, Page 5, being 100 Biscayne
Boulevard, located in a C-3 (Central Commercial) District,
be and the same is hereby granted.

Section 2. This variance shall become null and
void unless the use is commenced within six months of
the effective date of this Resolution. Extension may be
granted by the City Manager pursuant to the provisions of
Article XXXi, Section 4, of Ordinance No. 6871.

to permit construction of radio transmitting tower 407.75' high
(375' permitted), to be on top of structure on Lots 1, 2, and 3,
SMITH SUB (3-5), located at 100 Biscayne Boulevard; zoned C-3
(Central Commercial).
No objections were received in the mail.
A RESOLUTION to provide for this Variance has been prepared by
the City Attorney's office and submitted for consideration of
the City Commission.
