RESOLUTION NO.
A RESOLUTION GRANTING A VARIANCE FROM
ORDINANCE NO. 6871, ARTICLE V, SECTION 3
(2)(a), TO PERMIT ENCLOSURE OF EXISTING
CARPORT, ON LOT 18, BLOCK 27, BAY VISTA
PARK (5-47) , WITH SIDE SETBACK OF 3'
(5' REQUIRED), LOCATED AT 549 N. W. 42ND
STREET, IN AN R-1 (ONE -FAMILY) DISTRICT.
WHEREAS, the Planning and Zoning Board of the City
of Miami, at its meeting held on February 28, 1972,
passed and adopted by a 9 to 0 vote its Resolution No.
72-40, recommending granting a variance from Ordinance
No. 6871, Article V, Section 3 (2)(a), as hereinafter
set forth; and this Commission deems it advisable in the
interest of the general welfare of the City of Miami to
grant this variance requested on the ground that a refusal
would result in practical difficulties and unnecessary
hardship to the applicant under an R-1 (One -Family) District;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF
THE CITY OF MIAMI, FLORIDA:
Section 1. That the application for a variance from
Ordinance No. 6871, Article V, Section 3 (2)(a), to permit
enclosure of existing carport on Lot 18, Block 27, BAY VISTA
PARK, Plat Book 5, Page 47, with side setback of 3' (5' re-
quired), located at 549 N. W. 42nd Street, in an R-1 (One -
Family) District, be and the same is hereby granted.
Section 2. This variance shall become null and void
unless the use is commenced within six months of the effective

the City Manager pursuant to the provisions of Article
XXXI, Section 4, of Ordinance No. 6871.
