A RESOLUTION AWARDING THE BID RECEIVED MARCH 1,
1972, OF OBENOUR ROOFING, SHEET METAL AND SUPPLY
CO. , FOR THE MIAMARINA - MARINA FACILITIES REROOFING
- 1972 IN THE ESTIMATED AMOUNT OF $10, 505. 00; AND
AUTHORIZING AND DIRECTING THE CITY MANAGER TO
EXECUTE A CONTRACT THEREFOR; FURTHER PROVIDING
THAT THE CITY MANAGER MAINTAIN AN ACCURATE RECORD
OF ALL COSTS; FURTHER DIRECTING THE CITY ATTORNEY
TO INSTITUTE ON BEHALF OF THE CITY, A CLAIM TO
RECOVER THE FUNDS EXPENDED BY THE CITY FOR THE
REPAIR OF THE ROOF, AGAINST THE CONTRACTOR, NAT
HARRISON ASSOCIATES, AND/OR THE ARCHITECT, ALFRED
BROWNING PARKER, THE SURETY COMPANY, AND ANY OTHER
INDIVIDUAL AND FIRM WHO IS RESPONSIBLE FOR THE
INSTALLATION OF THE EXISTING ROOFING SYSTEM WHICH HAS
FAILED; AND -FURTHER PROVIDING FOR THE RE -ALLOCATION
OF $12,000 FROM EXISTING BOND FUNDS FOR CONSTRUCTION
OF MIAMARINA FOR THIS PURPOSE
WHEREAS, the roof of the Marina Facilities Building at Miamarina
has leaked during rainstorms since the day it was installed; and
WHEREAS, all efforts to force the architect, the contractor, the
sub -contractor and the roofing supplier to provide a leak -proof roof have
failed; and
WHEREAS, the Contractor has been officially notified to have the
roof fixed by February 20, 1972 which date has passed and no work has
been done to fix the roof; and
WHEREAS, it is the intent of the City to have the roof fixed by
another Contractor and after the repair is completed and all costs
ascertained to direct the City Attorney to bring suit against all parties
legally responsible and to recover the entire cost of the repairs; and
WHEREAS, bids were received March 1, 1972 for MIAMARINA -
MARINA FACILITIES REROOFING - 1972; and
WHEREAS, the City Manager reports that the $10, 505. 00 bid of
Obenour Roofing, Sheet Metal and Supply Co. is the lowest bid (acceptable)
and recommends that contract be awarded to said company; and

WHEREAS, funds are available to cover the cost of this work and
project expenbes within the original fund allocation for MIAMARINA -
CONTRACT "B't;
NOW, THEREFORE, BE IT' RESOLVED BY THE COMMISSION OF
THE CITY OF MIAMI, FLORIDA:
Section 1. That the bid of Obenour Roofing, Sheet Metal and
Supply Co. , received on March 1, 1972 for the Miamarina - Marina
Facilities Reroofing - 1972 based on lump sum price at a total estimated
cost of $10, 505. 00 be, and the same is hereby, accepted at the price
stated therein.
Section 2. That the City Manager be, and he is hereby, authorized
and directed to enter into a contract in behalf of the City of Miami with the
said company.
Section 3. That the City Manager be, and he is hereby, directed
to maintain an accurate record of all costs.
Section 4. That the City Attorney be, and he is hereby, directed
to institute on behalf of the City, a claim to recover the funds expended by
the City for the repair of the roof, against the contractor, Nat Harrison
Associates, and/or the architect, Alfred Browning Parker, the surety
company, and any other individual and firm who is responsible
--for -the installation of the existing roofing system which has
failed.

Section 5. That the sum of $12,000 be, and it is, hereby
re -allocated from existing bond funds for construction of Miamarina
for the purpose of accomplishing this re -roofing.
