HomeMy WebLinkAboutR-43306fr4 i PHT/fl 2/23/72 '72 FEB ZB AM 9:24 RESOLUTION NO. 546,3406 6 A RESOLUTION ACCEPTING THE PLAT ENTITLED MIDTOWN SUBDIVISION, A SUBDIVISION IN THE CITY OF MIAMI, FLORIDA, AND ACCEPTING THE DEDICATIONS SHOWN ON SAID PLAT, AND ACCEPT- ING A COVENANT TO RUN WITH THE LAND POSTPON- ING THE IMMEDIATE CONSTRUCTION OF A CONCRETE SIDEWALK, CURB AND GUTTER AND ASPHALTIC CON- CRETE PAVEMENT, AND AUTHORIZING AND DIRECTING THE CITY MANAGER AND CITY CLERK TO EXECUTE THE PLAT. WHEREAS, the City Planning and Zoning Board and the Department of Public Works have recommended the acceptance of the Plat; and WHEREAS, on December 16, 1971, the City Commission passed and adopted Resolution No. 43089 closing for public use the East-West and North -South alleys lying within the East 319.47 feet of Block 1 and alleys lying within the East 190.74 feet of Block 2, BRADDOCK SUBDIVISION NO. 4, Plat Book 3, Page 61, Dade County, Florida; and WHEREAS, it was recommended that the developers of MIDTOWN SUBDIVISION execute a Covenant to Run with the Land postponing the immediate construction of a concrete sidewalk, curb and gutter, and pavement widening on N. W. l4th Avenue and on N. W. 20th Street; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The Plat entitled MIDTOWN SUBDIVISION, being a subdivision lying in Section 35, Township 53 South, Range 41 East, City of Miami, Dade County, Florida, which by reference rr MEETING OF s WR2 tt 72 6 ittso iJ tttt NO.._.. . •••. ► is made a part hereof as if fully incorporated herein and the dedications as shown thereon together with all existing and future plantings, trees and shrubbery on said property, to the perpetual use of the public, be and the same are hereby accepted and confirmed by the City of Miami, Florida. Section 2. Except for the construction of these improvements provided for in the Agreement entered into between the Owner and the Director of the Department of Public Works on behalf of the City of Miami, Florida, dated January 20, 1972, the requirements of Chapter 54, Section 54-20, Code of the City of Miami, Florida, and State law as to improvements to be made in subdivisions will hereby expressly be waived. Section 3. The Covenant to Run with the Land executed by Midtown Bank of Miami postponing the immediate construction of 6-foot wide concrete sidewalk, concrete curb and gutter, 1-inch thick asphaltic concrete pavement widening including limerock base with necessary returns on N. W. 19th Street and 19th Terrace until such time as required by the Department of Public Works of the City of Miami, Florida, be accepted and recorded after the Plat has been recorded in the Public Records of Dade County, Florida. Section 4. Of all other requirements of State law concerning the posting of a Performance Bond for the con- struction of improvements, that portion pertaining to the maintenance of said improvements is hereby expressly waived. Section 5. The requirements of State law concerning the showing of grades of rights -of -way on the Plat are hereby expressly waived. Section 6, The City Manager and the City Clerk, both of the City of Miami, Florida, are hereby authorized and directed to execute the Plat. �J da PASSED AND ADOPTED this o'` Y of°91, , 1972.
