A RESOLUTION ACCEPTING A GRANT OF EASEMENT
DATED FEBRUARY 4, 1972 FROM MR. AND MRS.
J. ALLEN SCHUR FOR CONSTRUCTION OF A SANITARY
SEWER ALONG THEIR PROPERTY AT 1090 VENETIAN
WAY, MIAMI, FLORIDA.
WHEREAS, in order to proceed with certain construction
of a portion of the San Marco Sanitary Sewer Improvement
SR-5316-C (centerline sewer), an easement is needed for the
sewer location and a construction easement is needed during
the period of construction; and
WHEREAS, J. Allen Schur, individually and as trustee,
joined by his wife, Frances Schur, have executed and delivered
to the City of Miami, a Grant of Easement for the required
permanent and temporary construction easements and it is now
in order for the City to accept and record said Grant of
Easement;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF
THE CITY OF MIAMI, FLORIDA:
Section 1. That the February 4, 1972 Grant of Easement
executed by J. Allen Schur, individually and as trustee, and
joined by his wife, Frances Schur, for the therein described
land, be and the same is hereby accepted, a copy of said Grant
of Easement being attached hereto and by this reference made
a part hereof.
Section 2. That the proper officer of the City of Miami
is hereby authorized and directed to file said Grant of Easement

WITNESSETII, That said parties of the first part, for and in consideration of the sum of
One Dollar (S1.00) and other good and valuable considerations, to them in band paid by said party
of the second part, the receipt whereof is hereby acknowledged, do hereby grant, give and convey
to the party of the second part, its successors and assigns, forever, a permanent easement for the purpose
o/ constructing, laying and maintaining a Sanitary Sewer through, over. across and under the surface of
the following described land, situated in The City of Miami, County of Dade and State of Florida, to• wit:
The south 15.0 feet of the north 42.5 feet of the
following described parcels of land, to wit:
1. The northerly portion of the easterly 34.00
feet of Lot 8, Block 2, excepting the southerly
267.5 feet thereof; and
2. The west 67.0 feet of the east 101.0 feet of
Lot 8; and
3. Begin at the most westerly point of Lot 8 (see
legal description in I.F.F. Deed No. 19229, as
recorded in Deed Book 2794-494 of the Public
Records of Dade County, Florida) all in Block
2 of BISCAYNE ISLAND, according to the plat
thereof, as recorded in Plat Book 34; at Page
93, of the Public Records of Dade County,
Florida; also
A TEMPORARY CONSTRUCTION EASEMENT
A temporary construction easement for the purpose of access, oper-
ation and storage of materials, required for the construction.of
a sanitary sewer in the permanent easement, .said. temporary con-
struction easement being more particularly described as follows:
The south 10.0 feet of the north 27.5 feet of the above described
—Parcels 2 and 3. This temporary easement becomes null and void
upon the completion of the Sanitary Sewer.

IT IS UNDERSTOOD AND AGREED by and between the parties hereto that THE CITY OA MIAMI, a
municipal Corporation, agrees that the said Sanitary Sewer to be constructed under the property hereby
given for such right, shall always be maintained so as not to be or become a nuisance.
SHOULD the above easement be abandoned or discontinued by operation of law or otherwise, the said
easement shall cease and revert to the Grantor S herein, their heirs or assigns.
