FOUR - FIFTHS OF THE MEMBERS OF THE COMMISSION WEREAS# all e p1ovoes on Ili City, save end ekr', cot General Policemen and C iremefti mer;bers of Croup '2 cn The Miami City Employees' Retirement System, received a four percent (4%) salary increase effective Nottember 14, 1071; and WHEREAS, at the City Commission meeting of February 3, 1972 representatives of the policemen and firemen requested that the City Commission, in lieu of granting the aforesaid four percent (4%) salary increase to members of Group , of the aforesaid System; transfer the monies neces- sary to meet said four percent (4%) increase into the pension program fund so as to apply such amount toward the cost factor resulting from an increase in the annual pension allowance percentage base thereby increasing said base to two and one-half percent (2-1/2%) per year; and' WHEREAS, the Miami City Employees' Retirement, System (Ordinance No. 2230, December 6, 1939)was not included as a portion of the new Code of the City of Miami, Florida, effective September 1, 1967, as adopted by Ordinance No. 7585 (July 25, 1967 ;) and WHEREAS, said System now exists in the codified form as it appears in Chapter 2 of the Coda of the City of Miami, Florida, 1957, as amended, in addition to basic ordinance form; and WHEREAS, any addLtian or amendments to said System can thus be made by reference to the section designations as they appear in said Chapter 2 of the Cade of the City of Miami, Florida, 1087, as amended: NOW, THEREFORE, BE IT ORDAIN b BY THE COMMISSION ' , or THE CITE' OF MIAMI, pL RX Section 1. The Miami city Employees' Retirement system (Ordinance No. 2230, December, 6, 1939, as amended) , as said ordinance, as amended, appears in codification form as a part of Chapter 2 of the Code Of the city of Miami, Florida, 1957, as amended, is hereby amended by amending the rate of benefit for General Policemen n and Firemen Group 3.and substituting a new rate of benefit at the end of subsection 88(4) of said Chapter as follows: "Notwithstanding the foregoing, the minimum service retirement age and rate of benefit for General Policemen and Firemen Group 3 shall be as follows: General Police and Firemen: Min. Serv. Rate of Group Class Ret. Age Benefit 3 A 55 2.5009.E 3 B 60 2.500 3 A-1 55 2.500 3 B-1 60 2.500 3 A-2 50 2,500 The benefits as provided herein shall vest upon retirement and not diminish after ret.rement. +, eation 2i xf any section, sentence, clause, phrase or ward of this ordnance is for any reason held or declared to be unconstitutional inoperative or void, such holding or invalidity shall►got affect the remaining portions of this ordinance, and it shad be construed to have been the intent of the commission of the city of Miami to: pass this ordinance without such unc onstitutiona1., inva3 .d or inoperative part therein; and the remainder of this Ordinance' after the exclusion of such port or parts shall be deemed and held to be valid as if such parts had not been included therein. Section 3. That the requirement of reading this Ordinance on two separate days is hereby dispensed with by a vote of not less than fours -fifths of the members of the commission.
