SUBJECT: Request to Publish Notice for Public Hearing (Substitution) REFERENCES: ENCLOSURES: Advertisement Pursuant to City Code Section, 18-85, amended, it is respectfully recommended that the City Manager waive competitive sealed bidding methods via this written finding and reasons herein. Said waiver shall need to be ratified, confirmed, and approved by the Miami City Commission by four -fifths (4/5ths) affirmative vote during an advertised public hearing. These are my written findings waiving the requirements for competitive sealed bidding processes as not being practicable or advantageous to the City of Miami ("City") to provide design and construction of a soccer pitch to be installed on City -owned property located at 850 and 920 NW 23rd Street, insofar as an agreement with Miami Bethany Community Services, Inc., a Florida Not -For -Profit Corporation ("MBCS") to perform said work is reached. MBCS is a business entity based in Miami, FL. Established on July 10, 2003, this Corporation is recognized under the document number N03000005880. Governed by the Florida Department Of State, the company is listed in active status in state records. The proposed agreement between the City and MBCS provides for a collaborative effort where MBCS will provide design and construction of a soccer pitch. The total improvements are estimated at $500,000.00. A waiver is warranted because a separate competitive procurement for design and construction management is not advantageous to the City and risks losing the negotiated risk allocation (including the assumption of cost overruns) to MBCS. Re -procuring design, construction, and construction management services separately would materially increase the City's net cost for the improvements, and introduce delay and additional risk to the City. If the City Commission concurs, and ratifies, my finding by a 4/5ths vote, the City Administration will proceed to negotiate and execute an Agreement with MBCS for their performance of this work.
