HomeMy WebLinkAboutR-26-0235City of Miami Resolution R-26-0235 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 19273 Final Action Date: 5/28/2026 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), PURSUANT TO SECTION 18-85(A) OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, BYA FOUR -FIFTHS (4/5THS) AFFIRMATIVE VOTE, AFTER AN ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING, AND CONFIRMING THE CITY MANAGER'S FINDING(S), ATTACHED HERETO AND INCORPORATED HEREIN AS EXHIBIT "B," THAT COMPETITIVE NEGOTIATION METHODS AND PROCEDURES ARE NOT PRACTICABLE OR ADVANTAGEOUS FOR THE CITY OF MIAMI ("CITY"), AND WAIVING THE REQUIREMENTS FOR SUCH PROCEDURES; AUTHORIZING THE ALLOCATION OF FUNDS FROM THE DISTRICT 1 SHARE OF THE CITY'S MIAMI FOR EVERYONE ("MFE") PROGRAM, ON A LUMP SUM BASIS, IN A TOTAL AMOUNT NOT TO EXCEED FIVE HUNDRED THOUSAND AND 00/100 DOLLARS ($500,000.00), TO MIAMI BETHANY COMMUNITY SERVICES, INC., A FLORIDA NOT -FOR -PROFIT CORPORATION, FOR THE PURPOSE OF ACTIVATING THE CITY - OWNED PROPERTY LOCATED AT 850 AND 920 NW 23RD STREET, MIAMI, FLORIDA, 33127 ("PROPERTY") IN THE ALLAPATTAH NEIGHBORHOOD THROUGH THE CREATION OF A COMMUNITY SPACE FOR SPORTS AND RECREATION, YOUTH EDUCATION, FOOD DISTRIBUTION, AND OTHER DAILY PROGRAMMING FOR AT -RISK YOUTH AND FAMILIES IN DISTRICT 1 AND SURROUNDING NEIGHBORHOODS, INCLUDING THE DEVELOPMENT OF TWO (2) SOCCER FIELDS THEREON, TO BE KNOWN AS THE "ALLAPATTAH SOCCER COMMUNITY FIELD" ("PROJECT"); FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE A REVOCABLE LICENSE AGREEMENT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, BETWEEN THE CITY OF MIAMI ("CITY") AND MIAMI BETHANY COMMUNITY SERVICES, INC., A FLORIDA NOT -FOR -PROFIT CORPORATION, FOR USE OF THE PROPERTY FOR THE PROJECT; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ALL OTHER DOCUMENTS, INCLUDING ANY AMENDMENTS, RENEWALS, AND EXTENSIONS, PROVIDED ALL AGREEMENTS AUTHORIZED BY THIS RESOLUTION SHALL BE SUBJECT TO ALLOCATIONS, APPROPRIATIONS, AND BUDGETARY APPROVAL HAVING BEEN PREVIOUSLY MADE, AND SHALL COMPLY WITH APPLICABLE LAWS AND REGULATIONS INCLUDING, WITHOUT LIMITATION, THE CITY'S PROCUREMENT ORDINANCE, ANTI -DEFICIENCY ACT, AND FINANCIAL INTEGRITY PRINCIPLES, AS SET FORTH IN CHAPTER 18 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, AS MAY BE NECESSARY FOR SAID PURPOSE. SPONSOR(S): Commissioner Christine King, Commissioner Miguel Angel Gabela WHEREAS, on April 13, 2023, pursuant to Resolution No. R-23-0178, the City of Miami ("City") created the Miami For Everyone ("MFE") Program to assist communities facing the long- term complications resulting from declared emergencies and to address the specific needs of the most vulnerable residents and businesses, through a strategy of focusing the provision of City of Miami Page 1 of 3 File ID: 19273 (Revision:) Printed On: 6/4/2026 File ID: 19273 Enactment Number: R-26-0235 support towards priority areas of need that will further stabilize economic conditions within City Districts; and WHEREAS, Miami Bethany Community Services, Inc., a Florida not -for -profit corporation ("MBCS"), is a community -based organization in Allapattah that has served the City of Miami for over 30 years by providing programs focused on community development, food distribution to low-income families, youth sports and recreational activities, affordable housing initiatives, and support services that improve the well-being of underserved populations; and WHEREAS, on September 26, 2024, pursuant to Resolution No. R-24-0375, the City Commission approved a resolution authorizing the execution of a revocable license agreement ("RLA") with MBCS for the use of City -owned properties located at 850 and 920 NW 23rd Street for benevolent and charitable purposes, including food distribution; and WHEREAS, MBCS has submitted a grant application, attached hereto and incorporated herein as Exhibit "A," for the purposes of activating the property to develop and activate two (2) soccer fields at 850 and 920 NW 23rd Street in the Allapattah neighborhood, to be known as the "Allapattah Soccer Community Field," which, upon completion, will provide a community space for sports and recreation, youth education, food distribution for the needy, as well as other daily programming for at -risk youth and families in District 1 and surrounding neighborhoods (the "Project"); and WHEREAS, as of the date of the grant application, the City has not entered into an RLA with MBCS for the Project; and WHEREAS, the Project is expected to deliver a measurable impact within ninety (90) to one hundred twenty (120) days, serving more than one hundred thirty (130) at -risk youth and families daily and approximately forty thousand (40,000) residents annually; and WHEREAS, the City's District 1 Commissioner ("Commissioner") wishes to provide grant funds from the Commissioner's share of the City's MFE Program in an amount not to exceed Five Hundred Thousand and 00/100 Dollars ($500,000.00) ("Funds") for the Project; and WHEREAS, pursuant to Section 18-85(a) of the Code of the City of Miami, Florida, as amended ("City Code"), the City Manager has made a written finding, attached hereto and incorporated herein as Exhibit "B," that competitive negotiation methods and procedures are not practicable or advantageous for the City's provision of the Funds for the Project; and WHEREAS, the City Manager is requesting authority from the City Commission to negotiate and execute any and all documents necessary, all in forms acceptable to the City Attorney, for the allocation of the Funds for the Project; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble of this Resolution are adopted by reference and incorporated herein as if fully set forth in this Section. Section 2. Pursuant to Section 18-85(a) of the City Code, by a four -fifths (4/5ths) affirmative vote, after an advertised public hearing, the City Manager's written finding, attached and incorporated as Exhibit "B," that competitive negotiation methods and procedures are not practicable or advantageous for the City's execution of a revocable license agreement between City of Miami Page 2 of 3 File ID: 19273 (Revision:) Printed on: 6/4/2026 File ID: 19273 Enactment Number: R-26-0235 the City and Miami Bethany Community Services, Inc., for the Project and waiving the requirements for said procedures, are hereby ratified, approved, and confirmed. Section 3. Pursuant to Section 18-85(a) of the City Code, by a four -fifths (4/5ths) affirmative vote, after an advertised public hearing, the City Manager's written finding, attached and incorporated as Exhibit "B," that competitive negotiation methods and procedures are not practicable or advantageous for the City's provision of the Funds for the Project and waiving the requirements for said procedures, are hereby ratified, approved, and confirmed. Section 4. The City Manager is authorized' to allocate the Funds, on a lump sum basis, from the Commissioner's share of the City's Miami For Everyone ("MFE") Program to Miami Bethany Community Services, Inc., for the Project; provided, however, that disbursement of the Funds shall be expressly contingent upon the execution of a revocable license agreement between the City and Miami Bethany Community Services, Inc., for the Project, and the receipt of all required approvals. Section 5. The City Manager is further authorized' to negotiate and execute the foregoing and all documents necessary, including any amendments and modifications, provided all agreements authorized by this resolution shall be subject to all allocations, appropriations, prior budgetary approvals, and shall comply with all applicable laws and regulations including, without limitation, the City's Procurement Ordinance, Anti -Deficiency Act, and Financial Integrity Principles, as set forth in Chapter 18 of the Code of the City Miami, Florida, as amended, in a form acceptable to the City Attorney, and in compliance with all applicable laws, rules, and regulations, as may be deemed necessary for said purpose. Section 6. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: rge ng 111, C y ttor -y 5/18/2026 1 The herein authorization is further subject to compliance with all legal requirements that may be imposed, including but not limited to, those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted.
