A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO ACCEPT, BUDGET, ALLOCATE,
AND APPROPRIATE FUNDS FROM THE DEPARTMENT OF
ENVIRONMENTAL PROTECTION'S RESILIENT FLORIDA PROGRAM FISCAL
YEAR 2025-2026 IN AN AMOUNT NOT TO EXCEED FIVE MILLION, SIX
HUNDRED EIGHTY-SEVEN THOUSAND, SEVEN HUNDRED ELEVEN AND
00/100 DOLLARS ($5,687,711.00) ("GRANT FUNDS") AS SPECIFIED IN
EXHIBIT "A," ATTACHED AND INCORPORATED, FOR THE BRICKELL BAY
DRIVE SEAWALL FLOOD IMPROVEMENTS PROJECT 40-B193802
("PURPOSE"), WITH A REQUIRED LOCAL MATCH IN AN AMOUNT NOT TO
EXCEED FIVE MILLION, SIX HUNDRED EIGHTY-SEVEN THOUSAND, SEVEN
HUNDRED ELEVEN AND 00/100 DOLLARS ($5,687,711.00), FROM
PREVIOUSLY BUDGETED FUNDS, INCLUDING MIAMI FOREVER BOND
FUNDS, IN CAPITAL PROJECT NO. 40-B193802; AUTHORIZING THE CITY
MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL NECESSARY
DOCUMENTS, INCLUDING BUT NOT LIMITED TO, AMENDMENTS,
EXTENSIONS, RENEWALS, AND MODIFICATIONS, ALL IN FORMS
ACCEPTABLE TO THE CITY ATTORNEY, FOR THE ACCEPTANCE OF THE
GRANT FUNDS, ADMINISTRATION AND IMPLEMENTATION OF AND
COMPLIANCE WITH ALL APPLICABLE LAWS, RULES, AND REGULATIONS,
FOR SAID PURPOSE.

WHEREAS, the City of Miami ("City") submitted grant applications to Florida Department
of Environmental Protection ("FDEP") for the Brickell Bay Drive Seawall Flood Improvements
Project 40-B193802 and was awarded one (1) 2025-2026 grant award ("Grant"); and
WHEREAS, FDEP has awarded the City the 2025-2026 grant award for an amount not to
exceed Five Million, Six Hundred Eighty -Seven Thousand, Seven Hundred Eleven and 00/100
Dollars ($5,687,711.00) ("Grant Funds"); and
WHEREAS, the Grant requires match funds from the City in the amount of Five Million,
Six Hundred Eighty -Seven Thousand, Seven Hundred Eleven and 00/100 Dollars
($5,687,711.00) to be allocated from budgeted funds in Capital Project No. 40-6193802, which
is inclusive of Miami Forever Bond funds; and
WHEREAS, the Grant Funds will enhance shoreline resilience and help mitigate flooding
along the Brickell Bay Drive corridor; and
WHEREAS, the City wishes to accept, budget, allocate, and appropriate the Grant
Funds from FDEP as specified in Exhibit "A," attached and incorporated; and

WHEREAS, it is appropriate for the City Commission to authorize the City Manager to
accept, budget, allocate, and appropriate the Grant Funds, and to negotiate and execute any
and all necessary documents, including but not limited to, amendments, extensions, renewals,
and modifications, all in forms acceptable to the City Attorney, for the acceptance, administration
and implementation of, and compliance with all applicable laws, rules, and regulations, for said
purpose;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is hereby authorized' to accept, budget, allocate, and
appropriate the Grant Funds to be utilized for the purposes stated herein.
Section 3. The Capital Fund Project Number 40-B193802 is established, and the Grant
Funds are appropriated as described in Exhibit "A," attached and incorporated.
Section 4. The City Manager is authorized' to negotiate and execute any and all
necessary documents, including but not limited to, amendments, extensions, renewals, and
modifications, all in forms acceptable to the City Attorney, for the acceptance of the Grant
Funds, administration, implementation, and compliance with all applicable laws, rules, and
regulations, for said purpose.
Section 5. The allocation and appropriation of the funds referenced herein are subject to
all federal, State, and local laws that regulate the use of such funds and the receipt of all
necessary approvals, including, but not limited to the City Attorney.
Section 6. The City Manager is authorized to make any changes to adjust, amend, and
appropriate the City's Operating Budget, Five -Year Financial Plan, Strategic Plan, Multi -Year
Capital Plan, and any other documents as necessary and applicable, pursuant to the provisions
of this Resolution.
Section 7. Certain necessary actions by the City Manager and designated City officials
and departments made in order to update the Capital Plan, relevant financial controls and
computer systems in connection therewith, for project close-outs, and for grants and other
funding sources in progress in connection herewith are ratified, approved, and confirmed.
Section 8. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.2
1 The herein authorization is further subject to compliance with all legal requirements that may be
imposed, including but not limited to those prescribed by applicable City Charter and City Code
provisions.
2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
