Background of Item: The City of Miami ("City") submitted grant applications to Florida Department of Environmental Protection ("FDEP") for the Brickell Bay Drive Seawall Flood Improvements Project 40-B193802 and was awarded one (1) 2025 — 2026 grant award. FDEP has awarded the City the 2025-2026 grant award for an amount not to exceed Five million six hundred eighty-seven thousand seven hundred eleven dollars. ($5,687,711.00) ("Grant Funds"). The Grant requires match funds from the City in the amount of $5,687,711.00 to be allocated from budgeted funds in Capital Project No. 40-B193802. The Grant Funds will enhance shoreline resilience and help mitigate flooding along the Brickell Bay Drive corridor. The City wishes to accept, budget, allocate, and appropriate the Grant Funds from FDEP as specified in Attachment "A," attached and incorporated by reference. The Grant Funds will support improvements to the locations specified in Attachment "A," attached and incorporated, by enhancing their resilience to future natural disasters and water quality("Purpose"). It is appropriate for the City Commission to authorize the City Manager to accept, budget, allocate, and appropriate the Grant Funds, and to negotiate and execute any and all necessary documents, including but not limited to, amendments, extensions, renewals, and modifications, all in forms acceptable to the City Attorney, for the acceptance, administration and implementation of, and compliance with all applicable laws, rules, and regulations, for said Purpose. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is hereby authorized1 to accept, budget, allocate, and appropriate the Grant Funds to be utilized for the purposes stated herein. Section 3. The Capital Fund Project Number 40-B193802 is established, and the Grant Funds are appropriated as described in Exhibit "A," attached and incorporated. Section 4. The City Manager is authorized' to negotiate and execute any and all necessary documents, including but not limited to, amendments, extensions, renewals, and modifications, all in forms acceptable to the City Attorney, for the acceptance of the Grant Funds, administration, implementation, and compliance with all applicable laws, rules, and regulations, for said purpose. Section 5. The allocation and appropriation of the funds referenced herein are subject to all federal, State, and local laws that regulate the use of such funds and the receipt of all necessary approvals, including, but not limited to the City Attorney. Section 6. The City Manager is authorized' to make any changes to adjust, amend, and appropriate the City's Operating Budget, Five -Year Financial Plan, Strategic Plan, Multi -Year Capital Plan, and any other documents as necessary and applicable, pursuant to the provisions of this Resolution. Section 7. Certain necessary actions by the City Manager and designated City officials and departments made in order to update the Capital Plan, relevant financial controls and computer systems in connection therewith, for project close-outs, and for grants and other funding sources in progress in connection herewith are ratified, approved, and confirmed. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
