Appropriating the Grant Funds for the purpose stated herein; authorizing the City Manager to negotiate and execute any and all necessary documents, including but not limited to, amendments, extensions, renewals, and modifications, all in forms acceptable to the City Attorney, for the acceptance of the grant funds, administration and implementation of and compliance with all applicable laws, rules, and regulations, for said purpose. Background of Item: The City of Miami submitted grant applications to Florida Department of Environmental Protection (FDEP) for the East Flagami Flood Improvements Project 40-B223801 and was awarded one (1) 2025 — 2026 grant award. FDEP has awarded the City the 2025-2026 grant award for an amount not to exceed Five Million Nine Hundred Seventy Thousand Seven Hundred Eighteen Dollars and Zero Cents ($5,970,718.00) ("Grant Funds"). The Grant requires match funds from the City in the amount of $5,970,718.00, from previously budgeted funds in capital project No. 40-B223801. The Grant Funds will help with water quality improvement activities and low-lying areas that frequently flood due to overwhelmed stormwater systems during heavy rain and storm surges in the South Florida coastal community. The City wishes to accept, budget, allocate, and appropriate the Grant Funds from FDEP as specified in Attachment "A," attached and incorporated by reference. The Grant Funds will support improvements to the locations specified in Attachment "A," attached and incorporated, by enhancing their resilience to future natural disasters and water quality("Purpose"). It is appropriate for the City Commission to authorize the City Manager to accept, budget, allocate, and appropriate the Grant Funds, and to negotiate and execute any and all necessary documents, including but not limited to, amendments, extensions, renewals, and modifications, all in forms acceptable to the City Attorney, for the acceptance, administration and implementation of, and compliance with all applicable laws, rules, and regulations, for said Purpose. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is hereby authorized' to accept, budget, allocate, and appropriate the Grant Funds to be utilized for the purposes stated herein. Section 3. The Capital Fund Project Number 40-B223801 is established, and the Grant Funds are appropriated as described in Exhibit "A," attached and incorporated. Section 4. The City Manager is authorized1 to negotiate and execute any and all necessary documents, including but not limited to, amendments, extensions, renewals, and modifications, all in forms acceptable to the City Attorney, for the acceptance of the Grant Funds, administration, implementation, and compliance with all applicable laws, rules, and regulations, for said purpose. Section 5. The allocation and appropriation of the funds referenced herein are subject to all federal, State, and local laws that regulate the use of such funds and the receipt of all necessary approvals, including, but not limited to the City Attorney. Section 6. The City Manager is authorized' to make any changes to adjust, amend, and appropriate the City's Operating Budget, Five -Year Financial Plan, Strategic Plan, Multi -Year Capital Plan, and any other documents as necessary and applicable, pursuant to the provisions of this Resolution. Section 7. Certain necessary actions by the City Manager and designated City officials and departments made in order to update the Capital Plan, relevant financial controls and computer systems in connection therewith, for project close-outs, and for grants and other funding sources in progress in connection herewith are ratified, approved, and confirmed. Section 8. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: 1 The herein authorization is further subject to compliance with all legal requirements that may be imposed, including but not limited to those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
