City of Miami Legislation Resolution Enactment Number: R-26-0246 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 19286 Final Action Date:5/28/2026 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO ACCEPT AN ACCESS EASEMENT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FROM ACRE GCDM INVESTMENT, A DELAWARE LIMITED LIABILITY COMPANY REGISTERED TO DO BUSINESS IN FLORIDA, AND MIMO BAY APARTMENTS II, LLC, A DELAWARE LIMITED LIABILITY COMPANY REGISTERED TO DO BUSINESS IN FLORIDA, FOR THE INGRESS AND EGRESS OF EMERGENCY VEHICLES OVER AND UPON THE PROPERTY LOCATED AT 6445 NORTHEAST 7 AVENUE, MIAMI, FLORIDA 33130. WHEREAS, ACRE GCDM Bay Investments, LLC, a Delaware Limited Liability Company registered to do business in Florida ("Grantor"), is the fee simple owner of the affected property ("Affected Property"); and WHEREAS, MIMO Bay Apartments II LLC, a Delaware Limited Liability Company registered to do business in Florida ("Beneficiary"), is a beneficiary of the referenced ingress and access easement and is the fee simple owner of the benefitted properties, which are adjacent to the Affected Property; and WHEREAS, the City of Miami ("City") desires to assure emergency vehicle ingress and egress access to the Beneficiary from the Affected Property and the Grantor offered to grant an access easement to the City for emergency vehicle ingress and egress ("Access Easement") over a portion of the Affected Property, as more particularly described in Exhibit "A," attached and incorporated; and WHEREAS, the purpose of the Access Easement is to ensure that emergency vehicles will have ingress and egress access, including turn -around access, within the easement area; and WHEREAS, Beneficiary is in the process of finalizing a plat of the benefitted properties adjacent to the Affected Property and the Access Easement is required to complete the platting process; and WHEREAS, the Grantor and Beneficiary will maintain and assume liability responsibility for the Access Easement located on the Affected Property; and WHEREAS, the City agrees with the terms and conditions in the Access Easement, in a form acceptable to the City Attorney, and as referenced herein; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized' to accept the Access Easement for the Affected Property, in a form acceptable to the City Attorney, from the Grantor and Beneficiary. Section 3. The City Manager is further authorized' to negotiate and execute any and all other necessary documents related to the Access Easement, in a form acceptable to the City Attorney. Section 4. The City Manager is further authorized' to record said instrument in the Public Records of Miami -Dade County, Florida. Section 5. This Resolution shall become effective immediately upon its adoption.
