HomeMy WebLinkAboutR-26-0247City of Miami Resolution R-26-0247 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 19292 Final Action Date: 5/28/2026 A RESOLUTION OF THE MIAMI CITY COMMISSION APPROVING A NOISE WAIVER PURSUANT TO CHAPTER 36/SECTION 36-4 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED ("CITY CODE"), TITLED "NOISE/OPERATION OF RADIOS, PHONOGRAPHS, OR OTHER SOUND MAKING DEVICES; BANDS, ORCHESTRAS, AND MUSICIANS — GENERALLY; EXEMPTION" AND CHAPTER 36/SECTION 36-5 OF THE CITY CODE, TITLED, "SAME — HOURS OF OPERATION OF JUKEBOXES, RADIOS, ETC.; EXEMPTION FOR EVENTS ON CITY -OWNED PROPERTY; RELAXATION", FOR THE URBAN LOCATED AT 1000, 1020, 1024 NORTHWEST 2 AVENUE, MIAMI, FLORIDA AND THE SURROUNDING ADJACENT LOTS FOR EVENTS TO BE HELD IN CELEBRATION OF THE FIFA WORLD CUP 2026 FROM JUNE 19, 2026, THROUGH JUNE 21, 2026, AND JULY 18, 2026, THROUGH JULY 20, 2026; ART BASEL EVENTS FROM DECEMBER 3, 2026, THROUGH DECEMBER 6, 2026; AND A NEW YEAR'S EVE EVENT STARTING ON DECEMBER 31, 2026, THROUGH THE MORNING OF JANUARY 1, 2027. SPONSOR(S): Commissioner Christine King WHEREAS, the Urban ("Event Holder") is located at 1000, 1020, 1024 Northwest 2 Avenue, Miami, Florida, and the surrounding adjacent lots ("Event Site"); and WHEREAS, during normal operations, the Event Site is open from Friday through Sunday each week and provides outdoor activities including yoga, culinary showcases, music, local arts and crafts sales, as well as special events; and WHEREAS, the space is a unique neighborhood centered environment and gathering place; and WHEREAS, over the next few months the City of Miami ("City") community will be host to major events including the FIFA World Cup 2026 and the return of Art Basel; and WHEREAS, the Event Site has planned events for both local and international FIFA World Cup 2026 fans, Art Basel attendees, and its annual New Year's Eve celebration; and WHEREAS, Section 36-4(c) of the Code of the City of Miami, Florida, as amended ("City Code"), provides the City Commission with the authority to declare an exemption to Section 36- 4(a) of the City Code for special occasions; and WHEREAS, Section 36-5(c) of the City Code provides the City Commission with the authority to declare an exemption to Section 36-5(a) of the City Code for special occasions; and WHEREAS, there can be no open City violations or monies due and owing to the City on City of Miami Page 1 of 2 File ID: 19292 (Revision:) Printed On: 6/1/2026 File ID: 19292 Enactment Number: R-26-0247 any property that is being used as part of this noise waiver and any required permitting for the Events is required to be separately obtained; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The noise prohibition contained in Sections 36-4(a), (b) of the City Code is waived pursuant to Sections 36-4(c) of the City Code for Events which will occur at the Event Site on: 1. FIFA World Cup 2026 Celebration from June 19, 2026, through June 21, 2026; July 18, 2026, through July 20, 2026; 2. Art Basel Events from December 3, 2026, through December 6, 2026; and 3. New Year's Eve Events from December 31, 2026, through the morning of January 1, 2027. Section 3. The noise prohibition contained in Sections 36-5(a) of the City Code is waived pursuant to Sections 36-5(c) of the City Code for Event which will occur on: 1. FIFA World Cup 2026 Celebration from June 19, 2026, through June 21, 2026; July 18, 2026, through July 20, 2026; 2. Art Basel Events from December 3, 2026, through December 6, 2026; and 3. New Year's Eve Events from December 31, 2026, through the morning of January 1, 2027. Section 4. All other requirements of State law and the City Code, including Special Event and Building Permits as required, shall be met before this waiver is valid. Section 5. No waiver shall apply to private properties with open violations, including those complied but unpaid, or monies due and owing to the City. Section 6.
