A. REQUEST
Melissa Tapanes LLahues, Esquire, on behalf of Braman Motors and Biscayne 2020 Blvd,
LLC, (the "Applicant") pursuant to Chapter 55, Section 55-15(a) of the City of Miami Code
of Ordinances, as amended, (the "City Code"), requests to vacate and close a private alley
approximately 500 feet that runs East to West generally located along the between the
properties running along Northeast 20th Terrace and Northeast 20th Street bounded by
Northeast 2 Avenue on the west and Biscayne Boulevard to the east (the "Private Alley").
B. RECOMMENDATION
Pursuant to Chapter 55, Section 55-15(a) of the City of Miami Code of Ordinances, as
amended, the Plat and Street Committee and Planning Department recommend Approval
with Conditions of the requested vacation and closure of a private alley based on the facts
and findings in this staff report.

C. BACKGROUND
Pursuant to Miami City Commission Ordinance 1098, the alley was dedicated for private
use as shown on the Plat of Bayside Park, recorded in Plat Book 2,
Page 23, of the Public Records of Miami -Dade County, Florida ("Attachment 1").
On July 24, 2025, pursuant to City Commission Ordinance 14387 ("Attachment 2"), the
Miami City Commission amended Ordinance No. 13114 (the "Miami 21 Code") to add
Appendix Q, titled "Braman Miami Campus Special Area Plan," which includes the
Property and Private Valley.
On April 4, 2024, the City of Miami Plat and Street Committee approved the "NB
SUBDIVISION" Tentative Plat #2053 (the "Tentative Plat") by a vote of 4 to 0
("Attachment 3").

The Alley Vacation is generally located along the south side of Northeast 20 Terrace,
from Biscayne Boulevard to Northeast 2 Avenue; and along the north side of Northeast
20 Street, from Northeast 2 Avenue to the east.

E. PROPOSAL
The Applicant is proposing to vacate and close a private alley of approximately 500 feet
generally located along the between the properties running along Northeast 20th
Terrace and Northeast 20th Street bounded by Northeast 2 Avenue on the west and
Biscayne Boulevard to the east
F. ANALYSIS
Chapter 55, Section 55-15(c)
Pursuant to Chapter 55, Section 55-15(c) of the City Code, "In addition to review for
technical compliance, the plat and street committee shall also consider the request for
vacation and closure with respect to the following:"
Criteria 1:
Is it in the public interest, or would the general public benefit
from the vacation of the rights- of -way or easement?

Finding 1:
The ally closure is in the public interest. The alley is private and it is
used fully by the current owners -a car dealership -in connection with
their operations. The alley does not serve the general public.
Criteria 2:
Is the general public no longer using the rights of way or easement?
including public service vehicles such as trash and garbage trucks,
police, fire, or other emergency vehicles?
Finding 2:
The subject alley is private, and the general public has never used
the alley. The ally is not used by public service vehicles, and it is
generally occupied with standing vehicles related to the owners
operation of a car dealership.
Criteria 3:
Would there be no adverse effect on the ability to provide
police, fire, or emergency services?
Finding 3:
There would be no adverse effect on the ability to provide police,
fire or emergency services. The alley is strictly private. The lots
abutting the property on both sides have two to three frontages
from which emergency services can be provided.
Criteria 4:
Would the vacation and closure of the rights of way or
easements have a beneficial effect on pedestrian and vehicular
circulation in the area?
Finding 4:
The ally closure would have no negative impact on pedestrians or
vehicular circulation in the area. Because the applicants have no
intention to cease operating a car dealership at the property, existing
pedestrian and vehicular circulation will be preserved.
G. FINDINGS
• The Applicant is the owner of the property located at 2020 Biscayne Boulevard, 250
Northeast 20 Terrace, 246 Northwest 20 Terrace, 234 Northeast 20 Terrace, 2001
Northeast 2 Avenue (collectively, the "Property").
• The Private Alley is generally located between the properties running along Northeast 20th
Terrace and Northeast 20th Street bounded by Northeast 2 Avenue on the west and
Biscayne Boulevard to the east
• The Property and Private Alley are located within the "T6-36A-O," Urban Center Transect
Zone — Open.
• The Property and Private Alley are located within Wynwood-Edgewater Commissioner
District Office.
• On April 4, 2024, in a vote of 4 to 0, the City of Miami Plat and Street Committee approved
the Tentative Plat.

• Based on the Tentative Plat, the Private Alley is approximately 7,354 square feet or 0.169
acres.
• The total perimeter of the Applicant's property abutting the Private Alley is approximately
1,417.75 feet
• The Plat and Street Committee reviewed the request for the vacation and closure of the
Alley Vacation pursuant to the criteria as set forth in Chapter 55, Section 55-15.
• The Plat and Street Committee found the request to comply with the criteria.
• Pursuant to the provisions of Chapter 55, Section 55-15(a) of the City Code, as amended,
the City's Department of Resilience and Public Works and Office of Capital Improvements
researched for any City projects involving the Private Alley.
• Signed letters were provided confirming that the City has not expended any funds within
the prior fifty (50) years and/or any restricted funds on improvements.
• The Private Alley is consistent with Article 2, Section 2.1.2.b.4 of the Miami 21 Code in
that the proposed vacation of the private alley will allow for an increased lot size allowing
the business to expand in one of the highest density neighborhoods of the City.
Additionally, the vacation will facilitate future developments to obtain higher density
• The vacation is consistent with Goal LU-1 of the MCNP because the proposed closure
supports the efficient use of land and encourages compact design while protecting and
enhancing residential areas within neighborhoods
H. CONCLUSION
Pursuant to Chapter 55, Section 55-15(a) of the City of Miami Code of Ordinances, as
amended, the City of Miami Plat and Street Committee and Planning Department
recommends Approval with Conditions of the requested vacation and closure of a private
alley based on the facts and findings in this staff report.
I. CONDITIONS
1. Tentative Plat #2053 ("NB SUBDIVISION") shall be developed in accordance with the
survey digitally signed and sealed by Alberto J Rabionet, Mark Steven Johnson,
Professional Surveyor and Mapper, No. 7218, State of Florida, on August 12. 2024, 2022,
and approved by the Plat and Street Committee, bearing the e-Plan approval stamp PZ-
25-19095.
2. The Applicant, owner or its successor shall comply with the conditions of approval stated
for Tentative Plat #2053, in the letter dated May 28, 2024, issued by the Department of
Resilience and Public Works.

3. The Applicant, owner, or successor shall meet applicable development standards
identified in the Miami 21 Code and all applicable local, county, state, and federal
regulations.
4. The Applicant, owner, or their successor shall provide an access plan for review and
acceptance by the City's Fire -Rescue, Police, Solid Waste Departments, and the Capital
Improvements Program/Office Transportation.
5. Approval of the requested vacation and closure shall be valid for a period of four (4) years
and shall remain independent of the referenced tentative plat during this period, pursuant
to Section 55-15 of the City of Miami Code of Ordinances, as amended.
6. A Certificate of Occupancy shall only be issued after all the required improvements have
been completed.
7. The City reserves the right to inspect the site to ensure compliance with the conditions
listed.
